乌坎:山雨欲來 (上)

2011年12月23日一大早,中国妇权网记者在乌坎村看见与前几天决然不同的景象,街上见到学生背着书包去上学,村里见不到讲普通话的外地人,外国人更是一个都没有,说是都走了,去了汕头,但也有三五成群的聚在一起议论,还有政府工作组人员在问村民们问题,或做调查。商店也都陆续的开门营业,学生们开始上课了,派出所警察也开始正常上班,警局院里院外停了好几部警车。九点左右,村民们陆续集结到村临时理事会的门口,讨论政府承诺今天放回来两个人的事情

记者在和几位妇女的闲聊中了解到,她们都一口否认乌坎村原先隶属政府的妇女联合会,她们说,由于失去土地,青壮年男人大都出去打工了,所以参加抗议的妇女显得特别多,但与原来的妇联会没有关系。当然,记者知道乌坎村自发民选的“乌坎村妇女代表联合会”已经成立,并选出了妇女主任,和原先的妇联在属性和选举方式完全不同。

午饭后,听见鞭炮声,很多人往村后跑去,记者也跟着进去,原来是被抓的村民庄烈宏放回来了,庄家低矮的房子里挤满了人,多数人是来送礼慰问的,场面非常热闹。等村民们走的差不多了,记者才挤了进去。庄先生三十岁左右,对我这个外乡人很是热情,递烟、倒茶,但当记者开口问他在关押期间挨过打没有时,他借口心情不好,没有问答,因此也不好再继续打扰。

22日天(昨天),广东省委副书记朱明国星期三单独同乌坎村代表理事会会长林祖銮举行了“谈判”。承诺了村民的三点要求:交还薛锦波遗体、释放被捕的其他三名村民代表,并安排五家国际传媒机构亲验薛锦波遗体;承认临时村代表理事会的地位。乌坎村代表则同意取消原定于当天进行的游行。但直到下午五点时截稿时,政府承诺将释放的另一名村民曾昭亮还没回来,据说他是被关押在顺德,薛锦波遗体也没有运回。

目前在乌坎村,除了省工作组的几个人找村民调查外,村民们大都不太说话。问什么事都是尽可能的避而不谈,昨天放回家的张建城和今天的庄烈宏都是以取保候审的名义放回来的,政府还是把他们当作是犯罪嫌疑人,而且都是签了“保证书”才放的,也就是,他们仍是有罪嫌疑人,任何时候都有可能再被带走,这无疑让抗争了好几个月的村民感到忧心重重,加上村里走来走去的省、市工作组人员及便衣公安,街上不断增加的《严厉打击无政府行为》、《打击黑恶势力》等口号标语等,总让人感到离秋后算帐不是太远了。

虽然政府承认民选的“乌坎村村民临时代表理事会”合法,但听村民说这所谓合法的临时理事会不久也会解散,要重新选举新的村民委员会,现在的村党支部虽然已经瘫痪,但政府也不可能让一个有着一万多人的村子没有党组织,这在中国几乎是不可能的,村民们担心,在党的组织重新调整建立起来后,一切还会照旧。

有村民相信,土地问题可能会解决;但民选的村理事会也一定会重新“被”党领导,只要有党组织的存在,就不可能有真正的民选,而且有被抓捕判刑的可能。

趁这个机会,我在理事会里找到了几个妇女,问及成立的妇女联合会的问题,出我意料之外,几个妇女都一口否认乌坎村成立过妇女联合会,她们告诉我,由于失去土地,青壮年男人大都出去打工了,所以参加抗议的妇女显得特别多。她们介绍说,乌坎村四十年来就没见过有什么妇联,只是有一个妇女主任,而且很多人都不认识。我说网上有过报道,她们告诉我:没那回事。后来我才知道,她们成立的是乌坎村妇女会,乌坎村从来也不存在什么妇女联合会。

中国妇权祝贺陈光诚生日 警方阻挠

2011年11月12日是山东盲人维权人士陈光诚的四十岁生日,世界各地人权人士纷纷为陈光诚举行生日集会。
2011年11月11日,中国妇权多名义工邀请了来自各地的三十多位维权人士在安徽省合肥市某酒店举行集会,祝贺陈光诚四十岁生日快乐,并声援陈光诚维权行动。在活动举行之前,合肥当地警察在酒店外面阻挠中国妇权邀请的多名维权人士,不让他们进入酒店参加活动集会。先期进入酒店的中国妇权义工和维权人士如期举行了陈光诚四十岁生日祝贺活动,戴上了具有象征意义的墨镜。中国妇权义工特意制作并展示了印有“《中国妇权》祝陈光诚生日快乐”的横幅。
中国妇权合肥陈光诚生日祝贺活动不顾当地警方阻挠如期举行,来自各地多名维权人士积极参与该活动。据悉,中国妇权相关声援陈光诚活动将继续举行。

采访强制流产一尸两命惨案 中国妇权义工遭恐吓

2011年10月25日,笔者接到中国妇权负责人张菁女士的电话,连夜赶到山东省东营市利津县姜家庄村,探访一个被当地计生办强制引产而至死的孕妇家庭,怀孕近7个月的马继红日前被抓去强制流产,釀成一尸两命惨案。

姜家庄村位于利津县城以北15公里的310省道边,这一带的农民看上去经济状况还都比较宽裕,村子里几乎家家都盖有砖房,受害者一家就住在村子最北头的两间草房里,与邻里高大的围墙不同的是,这家的两间房和围墙都是土垒的,看起来像是全村最穷的家庭。
笔者来之前给死者马继红的丈夫高学涛打了好几个电话,问他家住的具体地方,高不是不接电话,就是说:“我已经没有了家”。我非常理解他的心情,只得租了部车沿路问,最后才找到了姜家庄。
进了门,高学涛正在喝稀饭,没有菜,手里抓了个馒头在啃,见我也不愿答话,他妹妹说哥哥刚从县里与政府谈判回来,这些天来脑子受了剌激,整天都是晃晃忽忽的。
笔者环顾屋里,不大的屋前有一半是被新收的棉花所占着,土灶边放了个煤气炉,边上的一个小房间里有一台旧电视机,其他的都是一些破破烂烂的东西,简直就象一个收破烂的仓库。马继红没死前家中有六口人,爷爷、奶奶、夫妻俩加上两个孩子,十亩地,主要是种棉花,全年的收入也只有一万元人民币左右,人均年收入大約人民币一千八百元,每月人均25元,每天人民币0.83元,不够买一斤下等大米,换成美元,每天每人仅有13美分。

高学涛吃完饭,坐在那动一不动,我问一句他答半句,还是老母亲和妹妹一边帮着答应。
高家发生的故事是这样的:那是11天前,也就是10月14号上午9点左右,利津镇计生办来了十几个人,开着一辆面包车,马继红看到计生办来了很多人,立即向村外跑,计生办的人跟着后面就追。由于怀了近七个月的身孕,在不远的棉花地里就被计生办的人按倒了,他们把马继红一路强行的拖到车上。车一溜烟的开走了,当时把马继红送到哪,家人一点也不知道。到了晚上9点多钟才有人来通知,说马继红在医院死了,这时候一家人赶忙到县医院,高学涛才看到了躺在手术台已经死去的妻子。
另据知情者悄悄透露,本月14号马继红被强行架入医院后严重可能受伤,出现缺氧体征,医院正在给予输氧时,被当地计生办的人强行摘下氧气罩,做引产手术,当时有10 多个人计生办人员在场,是下午 4 点进入手术室的。到底引产手术如何,是被折磨致死还是药物致命,只有医院和计生办人员知道,家属一直没有任何音讯。在家属得强烈要求下,晚上 10 点左右打开手术室门,家属进入手术室后,手术室内无任何医护人员,马继红冰冷的躺在手术台上没有了呼吸,眼睛还睁着。
高的妹妹说,嫂子身体很好,被抓走的前一天还在地里干活,绝对不是因病而死亡的。这些天,高学涛每天都去政府交涉,总是没有答案,为防止遗体腐烂,现在存放在县殡仪馆,没出生的孩子也还在马继红的肚子里,已经放了十多天了。现在,政府各部门都在相互推脱责任,在考虑采取什么办法把这件事压下来,根本不考虑死者家属的感受。
高学涛和马继红已经生有两个女儿,大女儿在上小学,二女儿刚上幼儿园,高是独子,想再生个男孩,因此才怀了这第三胎。
高学涛是个没什么文化的地地道道农民,突如其来的悲伤使他不能很清晰的理出思路,但却坚定的表示,要找律师为妻子讨公道,我和马继红女方家人也进行了商量,我们的共同意见是:必须立即进入法律程序,其因有二:一是进入法律程序后便可尽快的进行尸体解剖,弄清死亡真相,否则一旦遗体被政府强行火化,政府会把马继红的死因归就于其他而不是强行堕胎;二是进入法律程序后,对高家与政府相关部门谈判赔偿有利,在司法部门的监督下,相关责任部门便不能随意了结此案,以确保受害人正当的权利。
第二天一大早,也就是10月26日,我又去了一趟高家,想把身上还剩下的1000元人民币送给他们,只想聊表心意,以解他们的燃眉之急。
我租了一辆出租车,早上8点左右赶到高家,进院时发现院里有三个男人,高学涛在屋里,我进了屋,拿出了准备好的一千元人民币送给高学涛,此时院里的三个男人围了上来,高学涛表示坚决不收我的钱,把钱硬塞回我的口袋,塞了好几个来回,高对我说:现在这钱也解决不了根本问题,我需要你们更多、更大的帮助,我知道他指的是请律师。
见一旁的人越来越多,本来想再问几个问题此时也无法开口,便向高告辞,上了出租车,向利津汽车站的方向驶去。车开了十公里左右,进了加油站,车刚一停,我坐在副驾驶的门便被一个五十岁左右的男人拉开,那人问我是干什么的,我说你有什么事吗?他抓着我的衣服向外拉,要我跟他们走一趟,我把门重新用力关上、锁好,我问他凭什么要带我走,请他们出示工作证。
这时上来了一个领导模样的四十多岁的男人,我把车窗摇下一些,这人还比较和气,他说最近发现有人到高家行骗,只想核实你的身份,是不是来诈骗的。
我说我是应朋友之托到高家来看望他们的,他家出了这样的大事,我只是想捐点钱,高家连值一百块钱的东西都没有一件,谁还会到这么穷的人家来诈骗?你们也不要找这样一个根本就不成立的借口,要带我走,除非你们能拿出有执法权的证件,否则我是不会跟你们走。
加完油后,出租车司机上了车,见他们也不出示证件,启动车后就驶出加油站。面包车(车牌号为:鲁E-HKA901)也紧跟着我们。司机告诉我,车站肯定有他们的人在等着,建议我不要进站。见此情况,我请徐师傅向滨州方向开,徐师傅加大油门,面包车一直追到滨州境内才掉头走了。徐师傅一直把我送到了四十多公里外的滨州长途汽车站。

见过“贵人”的徐玉兰被抓起来了

11天前,一条微博引起了我的注意——

“我叫徐玉兰,女,50岁。请您们耐心看完,我在这十年来,是怎样从一个健康的女人变成一个没有子宫的残疾人,怎样从一个干部变成了一个东奔西走的上访户,变成了一个没有工作没有收入的流浪者。”

我顺着微博给出的链接找到了她的详细自述,转贴到几个论坛和我自己的博客上——http://yzz661023.blog.163.com/blog/static/323665720129561645405/。如果此地址被屏蔽,搜《为计划生育做贡献的悲惨遭遇》的网页快照应该可以找到。

到了上周五(12日),徐玉兰在网上留言问我电话,我告诉了她。一会儿之后她说她来北京了,想来看看我家孩子。我说不必,有什么问题就问。她执意要来,周六上午我们一家去科技博物馆以前我还给她发了条短信,告诉她我白天带孩子出去玩了。昨天(15日)下午她从国家计生委出来以后还是到我家里来了。

从2000年单位实行“减人增效”,她一个人干三个人的活。2001年2月2日,她意外怀孕一对双胞胎,单位指派她到沈阳第一人民医院做了药物引流,休息了两天就上班,还加班加点。引流不净加上劳累导致大流血10多天不止,吃药无效,引流20多天后单位给了5000元的现金支票到中国医大二院住院治疗,医院诊断出血原因为子宫内有“胎盘绒毛”,建议子宫切除。2001年4月26日徐玉兰不得不遵遗嘱将子宫完全切除。术后徐玉兰因为单位人手紧缺而很快又上班了,但经常肚子痛、腰痛、阴道及肛门伴有痉挛性阵痛、头晕、血色素低、头昏眼花、四肢无力,工作效率大减。2002年9月20日,徐玉兰因企业改制被下岗,断了生活来源,开始了她的申诉、上访人生。她要求工伤待遇完全符合政府有关规定(昨天我看过复印件,名称我忘了),但是一直得不到解决。

当然不是一直没有理睬她,做过纸面鉴定,但那是假的,根本没有检查身体就做好了(检查也没用,因为子宫已经切除了),与子宫切除前的医院诊断证明明显不符。当地计生委也曾经答应给她每月600元生活费,但是计生委自己却不掏钱,让转轨、兼并后的企业出,冲抵了她作为并未卖断工龄的下岗职工应该享有的劳动保障待遇,并且养老保险只给她交60%,医疗费用让她走市民医保不给另外报销,她觉得与工伤待遇相差太远,没有接受。

我看过徐玉兰的材料,徐玉兰的上诉经历有大量证据(我看到的是复印件),完全属实。

徐玉兰的运气并不总是那么差。从昨天的谈话我得知,她居然两次巧遇了当时在辽宁任职的现任中共中央政治局常委李克强,并将上访材料递到了时任辽宁省委书记李克强手中。第一次她与另外两个残疾人到中共辽宁省委去上访,想等李克强书记出来递材料,她上厕所去了,把材料暂时托给两位残疾人,从厕所回来亲眼见到李克强书记从车里出来、两位残疾人上前递材料的场景,把她的材料也顺便递上去了。第二次她在医院看病时感觉医院对面的沈阳市工会有些异样,一问得知是李克强书记在市工会视察工作,她立即打的回家取材料,回到市工会发现李克强书记的车还在,松了一口气,往会议室挤,被保安拦住,她说很崇敬李克强书记,只在电视上见过,想当面看看李书记长什么样,保安就把她放进了会议室。等李克强书记听完汇报离开会议室路过她身边的时候,她就喊:“李书记,我有冤情,我见过您一次,递过材料,但问题他们没给我解决。”同时把材料递给了李克强。她说后来她从工会打听到,李克强走时把材料转给了另外一个人,说“如果是合理合法的要求就帮她解决吧,别难为她”。

徐玉兰说当地进京上访的人很多都被拘留过、劳教过,但是她没有,可能跟她见过“贵人”有关。但是刚过了一天,徐玉兰的运气就没那么好了。

今天(16日)我从小学接孩子刚进家门,妻子告诉我手机响一阵了。我接过手机,里面有个女人哭诉,听不清楚,但她说姓徐我还是听到了。我已经猜到是昨天来我家的徐玉兰,叫她冷静点,说慢点,让我听清楚。她还是带着哭腔,但明显放慢了速度,加以东北口音本来好懂,我确信听明白了。徐玉兰说——

“午后我在王府井大街上走被北京警察抓到了派出所,他们诬陷我偷东西,女警察脱光了我的衣服检查,我没偷,当然什么也没搜到。但是他们还是不放过我,要送我上沈阳驻京办去,我怕去了挨打,死活不肯去。他们又打电话到我们当地的派出所,让当地派出所把我接回去。我现在还被关在王府井的派出所里,等我们当地的警察。我非常担心抓回去后被劳教,或者人没了。”

这话是我理顺了的。她说得断断续续,带着哭腔,充满了恐惧,尤其实说到“人没了”三个字的时候!

 

 

金志华夫妇轮番陷狱,是生二孩有罪还是读大学有罪?

浙江绍兴市越城区东湖镇大皋埠村金志华就生二胎被违法收取“社会抚养费”一事起诉当地计生局,终审败诉后被法院强制执行,法院已经扣划了他们的几乎全部工资(只给他们4口人留1千元生活费),还借口他们可能隐藏财产,以“拒不履行法院判决”为由轮番抓捕金志华夫妻。

2012年12月14日金志华给我的网易博客留言,称他已经被扣押在派出所,执行法官说“关我15后还要继续关15以后再关我老婆15天,再不履行就判刑”。金志华说,法院通知我们计生局申请执行时我就已经把家里的财产造了一份清单给法院,执行法官可能嫌那些东西不值钱没有拍卖,“我们每月的收入都被扣得只剩1千元生活费了,要靠父母接济才得温饱,难道要逼我们借高利贷交社会抚养费?”我第二天(周五)看到留言后已无法跟金志华联系,她妻子同样无法跟他取得联系。

今年4月已经因为同一理由关了金志华的妻子15天。那时他们的第二个孩子才1岁半,天天哭着要妈妈,吃不好、睡不踏实,瘦了一圈。金志华在妻子被抓后立即给法院写了一封信——

尊敬的越城区人民法院领导:

我是一案上诉人金志华,因东湖镇政府向你院申请强制执行,现将我妻子司法拘留15天,对于你们依法办事我毫无异议,而且拘留我妻子及15天的意见也是东湖镇政府所强烈要求的。他们就是要把我们做个典型案例,看以后还有谁敢起诉他们计生局(虽然走诉讼道路是法律赋予公民的权力,但这显然是一起恶劣的打击报复行为,正如他们所说东湖镇每年都有不少征收抚养费及向法院申请强制执行,但真正拘留过人这是10年来的第一次)。放眼全省乃至全国所有有关强制执行社会抚养费征收的案例中,有哪个是对一位女性下手的呢?此卑鄙无耻下三滥的手段也只有东湖镇政府想得出做得出来。对此我也想告诉东湖镇政府的负责人,如果你们还算是男人的话就放了我妻子,有本事你冲我来。我大女儿四周岁多小女儿才17个月大非常需要妈妈的怀抱。这几天两个孩子晚上睡之前都哭喊着要妈妈,为人父母的你们,不知有何感想,我相信人民法院不仅是讲法也是讲情理的,我别无他求,只是希望法院能听到孩子恳求的声音。

    我当时建议金志华发公开信,但是他不愿得罪法官,没有公开。法院也没有被他代替妻子坐牢的请求打动,足足关了他妻子15天!

金志华于2010年10月18日在绍兴市妇保院生育第二个女儿。2011年3月1日,绍兴市越城区人口计划生育和卫生局向金志华夫妇送达征收社会抚养费决定书“越计生征字[2011]第6号”,指控金志华夫妇不符合法定条件多生育一胎,征收社会抚养费153584元。

金志华打算起诉计生局,想请我代理他的案件,我没有接受,而且多次劝他不要打官司。下面是我给他的一些复信——

我不认为你起诉有什么意义。也许一万个人起诉有意义,但是我们等不到那一天。官司本身是打不赢的,打官司的目的是为了让记者报道。但是普通的诉讼很难吸引记者。

道理我的上诉状和周泽律师的代理词里已经说过了,不想一再重复。网友想打官司的很多,我一贯不支持,因为花费精力而没有效果。记者都是势利眼,没有特别吸引眼球的地方他们不会报道的。

他们可以强制执行你的财产。如果你没有暴力抗法,没有转移他们查封、扣押、冻结的财产,抓人是没有道理的。不过中国法院不守法也是很常见的。你要么找关系让他们不愿整你,要么让他们怕你不敢整你,要么确实没有钱,否则他们还是有办法查到的。

光诚的事闹成这样政府也不怕,会怕我?青岛马晓菊妥协了,江苏朱纪东本来也打算妥协换个镇少交点算了,但计生等他一撤诉就翻脸,重新作了一个差不多一样的社会抚养费征收决定书,被迫重新起诉。你有机会也妥协了吧,我不能鼓动别人当炮灰,所以我极不情愿给人写诉状、代理词之类。

金志华说他不能跟企图杀害他孩子的人妥协。2011年10月二审判决,金志华败诉。2012年10月金志华又提出了纠正错判的申诉。10月16日金志华告诉我,“我上周把申诉状给递到了中院,他们说为了指标现在暂时不回复我,等到12月份会给处理。”看了他的申诉状,我有些后悔当初没有接受委托担任他们夫妻的代理人。我原来想当然地认为他的案子跟我的差不多,没有仔细打听具体情况。金志华在申诉书中说——

申诉人沈××因上学由农业户转变为非农户口,但户口已于是2000年9月29日迁回原户籍所在地小皋埠村(原皋北村和小皋埠合并)。沈××在1996年皋北村经济合作社承包了土地,承包期至2028年。根据中华人民共和国土地管理法和农村土地承包法均规定了农村土地承包的期限是三十年不变,在法定承包期内,任何人不能剥夺其土地承包主体资格,即便个别农民存在户籍变动情况,集体组织也不能因此收回其承包土地。这即符合法律规定,又符合中央关于承包期内“增人不增地,减人不减地”的精神。既然是集体土地承包人当然也就是村集体经济组织成员;沈××作为因户籍制度改革变更为城镇居民的原农村集体经济组织成员,尚未享受到城镇居民社会保障待遇的,符合“浙人口计生委〔2008〕93号”文件的规定,应适用《浙江省人口与计划生育条例》第十九条有关农村居民的生育政策,在第一胎为女孩的前提下可以依法生育二胎。

《浙江省人口与计划生育条例》第十九条规定,“符合下列条件之一的夫妻,经批准,可以再生育一个子女:……(二)双方均为农村居民(农业人口,下同),已生育一个女孩的,但一方为机关、团体、事业单位和其他组织职工或一方从事工商业一年以上以及双方与企业建立劳动关系一年以上的除外;”。该条强调的显然是“从事农业的人口”而非“农业户口”。“浙人口计生委[2008]93号”文件则是对这一条件的进一步解释:“‘农转城’人员符合以下情况之一的,适用《浙江省人口与计划生育条例》第十九条有关农村居民的生育政策:一是户口登记在农村村民委员会并且属农村集体经济组织成员;二是成建制(包括户籍制度改革和城市建设用地)变更为城镇居民的原农村集体经济组织成员,且尚未享受到城镇居民社会保障待遇的。”虽然上大学转户口算不上“成建制”,但“浙人口计生委[2008]93号”文件规定的是“符合以下情况之一”,而沈××的户口“登记在农村村民委员会并且属农村集体经济组织成员”。

根据浙江省人口与计划生育条例第四十八条规定,“违反本条例规定生育的,对男女双方分别按照统计部门公布的当地县(市、区)上一年城镇居民人均可支配收入或农村居民人均纯收入的下列倍数征收社会抚养费:……(三)符合再生育条件但未经批准生育的,按照零点五倍至一倍征收;”。当地2009年农民人均收入为19198元,如果按零点五倍对双方分别征收,只能收“社会抚养费”19198元;即使按一倍对双方分别征收,也只能收38396元。绍兴市越城区收金志华夫妇153584元“社会抚养费”,不但没有法律依据,也违反浙江本地的土政策。

只能收“社会抚养费”19198元到38396元当然是按浙江省的有关规定算的。如果按我的看法,一分钱也不该交,因为国务院的“社会抚养费征收管理办法”和各省的“人口和计划生育条例”都违反了“中华人民共和国人口和计划生育法”,把收费变成了行政处罚。浙江、江西等地都制定有“征收社会抚养费和实施计划生育行政处罚的若干规定”,对征收“社会抚养费”和计生行政处罚适用同样的程序,就是将收费变成处罚的显而易见的证据。而事实上,连这样一个违法的“征收社会抚养费和实施计划生育行政处罚的若干规定”,绍兴市越城区计生局也没有遵守,他们不但没有经过听证等程序,而且连153584元是怎么算出来的都不告诉金志华夫妇,征收决定书直接由法律条文就蹦到了153584元这个数字。

金志华的妻子跟我说,“她有不少农村的同学都领证生了第二个孩子。她要是不上大学,生二孩就不会有这种横祸了。白花了父母几万元,找不到工作,只好回老家,结果不符合计划生育政策了,跟没上大学的同学比无缘无故地欠下计生局十几万的债,这说明中国的高等教育整个就是个坑人的大骗局。”

金志华现在拘留所里处境如何,没有人知道。拘留所的人告诉他妻子,只有周二、周四才可以探视一会儿。

我们正在寻找希望加入到反性别暴力“十六日”行动中的志愿者和社团机构,如果你对上述问题很好奇,如果你对推动妇女权益感兴趣,如果你渴望用行动去改善和倡导人权,如果你希望认识更多志同道合的人,加入我们吧!

工作坊简介:

本次工作坊为期两天,分两次。第一天(11月4日),专家将和参与者一起探讨反对性别暴力的理念和做法,激发参与者设计活动方案。工作坊结束之后,将会有一个小额资助项目的招标,邀请参与者申请项目开展反性别暴力的行动。

第二天(11月16日),获得资助开展16日活动的团体代表或个人将参加进阶培训,以完善活动设计方案,促使资源共享。

工作坊主要内容:

1、反对性别暴力的理念与方法(何为性别暴力?);

2、16日行动介绍;

3、性别暴力案例分析(如家庭暴力、约会暴力等)及倡导策略;

4、活动计划讨论和交流;形成开展活动的支持网络

剩女是个小问题 剩男才是大问题

主讲人简介: 李建新,人口学法学博士,北京大学社会学系、社会学人类学研究所教授。主要研究领域为人口学、人口社会学、健康老龄学等方面。著有《转型期中国人口问题》、《中国人口结构问题》。

 

日前,人口学家李建新教授在北京大学做讲座时表示,剩女并非适婚女性太多,而是女性对婚配的自主选择,剩男则是因为男性适婚人口大量绝对过剩,这种现象容易给社会带来各种问题。

人口性别的失衡以及快速老龄化,还会给国家经济增长带来负面影响,从而削弱在大国争雄中的竞争力。

人口危机•性别失衡

“越南新娘” 折射中国“媳妇荒”.

去年8月,各大媒体都报道了上百名越南新娘被卖到湖南山区后集体失踪的事件,一时间贫困落后地区的男人讨妻难成了关注的热点,反映了一些地区“媳妇荒”的现象。

近年来,不断有报道称我国一些发展落后的农村地区和边远山区出现“光棍村”,而且“买卖新娘”的现象时有发生,这些典型事件反映出我国农村等落后地区婚配人口性别比例严重失衡的现实及后果。

一方面,弱势群体受到伤害;另一方面,婚配市场上男女比例严重失衡的现实又成为不法分子拐卖妇女、买卖婚姻的土壤。就全国而言,可以看到,一边在许多农村落后地区是“光棍村”兴起,另一边在不少大城市,确实“剩女”不断。

由此,中国可能会迎来以男女性别结构失衡为基础的婚姻挤压及社会不稳定。

人口危机•原因解析

人为干预 男女失调近30年.

人口出生性别比是人口性别结构的基础指标,出生性别比是指在一定时期(通常指一年)出生的婴儿中男婴和女婴之比,一般以每100个女婴对应多少男婴来表示。

从生物学的意义上讲,出生性别比是个常数,即在没有外部因素干预生育行为的条件下,出生性别比应该是稳定在105左右的常数。

新中国成立以来到20世纪70年代末,我国人口出生性别比虽然在个别年份如1966年偏离正常值,但基本上是在正常值(103-107)之间波动。

然而,从20世纪80年代,特别是80年代中期开始,我国人口出生性别比偏离了正常值。到90年代以后,人口出生性别比超过了115,甚至超过120,严重地偏离了出生性别比的正常值范围。直到2010年人口普查结果显示,出生性别比高达118,失调长达近30年。

人口危机•今后影响

10年以后,2600万人面临打光棍.

从2010年起,20世纪80年代中后期出生的失衡男女渐次进入婚育期,男多女少的婚姻挤压现象已经开始显现并积累。

2020年前后,我国“婚姻市场”将会发生质的变化,推算数据显示,2020年,22-34岁男性人口将比其婚配的女性人口多出2600多万。即便是从现在起出生性别比迅速恢复到正常值范围,适婚男性人口绝对过剩的婚姻挤压现象也会越来越严重,且会持续到2030年以后。

当然,年龄性别结构平衡只是人们婚姻的基础。现实的婚姻,不仅与婚配男女人口的年龄性别结构有关,还与社会经济条件、婚育观念因素有关,这其中人们的社会经济地位对婚配模式影响较大。

人口危机•男女有别

剩女是个小问题 剩男才是大问题.

现实中的男女婚姻模式除了“门当户对”,还有一种是“嫁高娶低”、“男高女低”的梯度婚配模式。

如果以甲、乙、丙、丁等表示个人的社会经济地位排序的话,那么男女婚配的这种模式是甲男乙女、乙男丙女、丙男丁女,在这种婚配模式下,这个社会上最终剩余下来的就是甲女丁男。若以教育程度地位为例,男博士娶女硕士,男硕士讨女学士,最后剩下的可能是女博士和男文盲。

所以,男女适龄人口比例严重失衡加上实际的婚配模式落差,造就了剩男剩女们。不过,剩男剩女是性质完全不同的群体。

剩女不是女性适龄人口的绝对剩余,而是来自社会婚配模式和个体婚姻的选择。这个群体的特点是,她们大多占据主动和优势地位,经济独立而且自主性强,其中还不乏不婚主义者。

相反,剩男就不一样了,剩男是男性适婚人口大量绝对过剩,且他们还多处于被动和劣势地位。

口危机•带来危害

剩男危机 对家庭社会都不利.

这样一个被社会遗忘的社会底层大众,若没有必要的“安全阀”,必定会给社会带来巨大的负面冲击。可以推断,随着这些想结婚而又无法找到配偶的大龄男青年和终身未婚男性数量的不断积累,社会不稳定和不安定的风险将大大增加。

婚姻挤压会对传统家庭稳定带来巨大冲击,将可能引起婚姻家庭道德危机。初婚期的男性由于数量绝对超过女性,女性作为一种稀缺的社会资源,会在男性间产生激烈的争夺和冲突,因而滋生婚外恋、第三者插足、离婚率、非婚生育、婚外生育等社会现象和道德问题。

同时,婚姻挤压对社会稳定也会产生不利影响。社会地位高的男性如职业好、收入高、有文化、有住房等择偶不存在问题,但社会地位低的男性,如文化水平低、收入少等择偶将非常困难。

而且,由于女性普遍短缺,在人口流动的条件下,女性人口可能以婚迁形式从不发达地区迁移到发达地区,如从农村到城市,从中西部地区到东部地区。那些贫困落后地区条件差的男性将成为婚姻挤压下最大的“受害者”,这种现实在客观上刺激并加剧了落后地区拐卖妇女、买卖婚姻、性犯罪现象的发生。

人口危机•国力兴衰
世界人口 中国男女比例降至新低
除了关注男女性别结构失衡外,我国人口年龄结构过度老化可能对经济发展造成不利影响。

2011年10月31日世界迎来了70亿人口日,不同以往的60亿日和50亿日,现在世界人口已处于低增长。预计到2050年世界人口将超过90亿,且人口增长率将进一步下降到0.36%左右,回到工业革命以前的水平。21世纪末,世界人口规模将达到顶峰100亿左右,之后人口增长将趋于零增长。

在世界上特别是发展中国家人口持续增长的同时,作为发展中国家的中国人口已经处于低惯性增长,且在不久的将来出现负增长。

我们已经看到,中国人口占世界人口的比例正在迅速下降,目前已经降到了19%,这是有史以来最低的比例,而且还将继续下降到10%以下,再创历史新纪录。

更值得注意的是,目前中国新出生婴儿的比例只占世界新出生婴儿的12%,而根据预测,到2060年,中国新生婴儿的比例将进一步降低到6%。

人类历史上中国这个人口大国如此急速变化会带来什么样的后果呢?

文明冲突,就是人口共同体冲突.

早在20世纪90年代初期,美国著名学者塞缪尔•亨廷顿就撰文指出,国际社会关系为“文明冲突”。亨廷顿认为,在20世纪90年代冷战对抗结束之后,将是一个多极和多文化的世界,是一个包含了七八种文明的世界。亨廷顿充分认识到人口规模、人口结构(年龄结构、宗教、文明、族群结构)的变化对一个民族、一个国家、一个文明兴衰的巨大影响。

亨廷顿认为,“文明的冲突”实际上就是西方文明与儒家文明和伊斯兰文明之间的冲突,也就是这些不同文明的人口共同体的冲突。

人口数量规模和年龄结构的变化对文明兴衰有着很强的影响。

被拐卖22年 中国妇权帮她找亲生父母

22年前,她被人拐卖到福建;22年来,她无时无刻不在思念家乡。昨日,在中国妇权(WRIC)《回家网》志愿者的帮助下,贵州籍女子彭清兰回到了已记忆模糊的普定老家。

今年7月,由安徽志愿者姚诚发起的《回家网》寻亲联盟来到福建莆田宣传并发放了上万册寻亲档案,无意当中,彭清兰看到了自己的名字,她随即给姚诚发了条短信。

“我看到信息时很激动,当时就想一定要帮助她‘回家’。”姚诚说。几经辗转,彭清兰和家人终于联系上,并确认她就是20多年前走失的彭家女儿。

昨晚8时许,彭清兰携丈夫远涉千里来到了普定县马场镇,虽然天色已晚,但彭清兰却听到久违的鞭炮声。马场镇60余位远亲近邻听说彭清兰回家了,纷纷自发前来迎接,彭清兰刚下车,父母亲就拥了上来:“姑娘啊,我是你爸爸,22年,我们是度日如年。”彭70岁的父亲泪如泉涌。彭清兰的姐姐站在一旁,看着妹妹愣了好一会儿,才抹着眼泪拉过身边的儿子说,“儿子,快叫姑姑。”

彭清兰1988年被人拐到福建莆田,那时,她只有9岁。彭清兰说,她只知道家乡叫平寨,家乡有条美丽的河,赶集时,当地男女在鞭炮声中欢快对歌的场景是她关于家乡为数不多的记忆。彭清兰说,她认字不多,每听到有人提起贵州,她都会忍不住多问几句,“知不知道有个叫平寨的地方,那里有条河。”但仅凭这些,她得不到家乡的消息。

在彭清兰工作的工厂里有不少贵州籍工人,别人都不相信满口闽南话的她是老乡。2000年,彭清兰与现在的老公相识并已有身孕,就在那时,她第一次有了“寻根”的想法。“我的后代要出生了,尽管他可能不会说家乡话,没有见过大山,但他体内流着贵州人的血。”彭清兰现在操着一口普通话,和记者交谈时,她也听不太懂乡音,她不希望孩子也是这样。当年,彭清兰从电视上看到有凯里市公安局在外省打拐成功的消息,便托朋友代笔,给凯里警方写了一封信,希望警方找到自己的家人,一等10年过去,彭清兰没等到回音。

昨夜,在普定县马场镇这个叫平寨的小山村,欢笑充满了每个角落。彭清兰告诉说,以后每年,她和丈夫都会定期回贵州老家,看看老人,看看亲人。

New York Memorial for Tibetan and Han Self-immolation Protests on Human Rights Day 

Sponsored by Women’s Rights in China and joined by several activism organizations, the New York Memorial for Tibetan and Han self-immolation protests was held on Dec. 11, 2012, to show the concern for those dead and wounded Tibetan and Han people for defending human rights, and to pay last respect to all who sacrificed their lives. At the opening of the memorial, all participants stood in silence to pay last respect for the dead rights defenders and to express condolences to their families. The participants urged to make the crisis of self-immolations an international issue and enjoined the new leadership of the Chinese Communist Party to squarely face the important issue, to adopt policies that defend the principles and purposes of the Charter of the United Nations and that show its respect and kindness to Tibetans and all ethnic groups. The participants also demanded that the Chinese government treat the two Nobel laureates with fairness, by freeing Liu Xiaobo and welcoming Dalai Lama.

Tenzin Dolkar, USA Grassroots Director of Student Free Tibet, with Mr. Yu Yang interpreting into Chinese, said that in the past 3 years, at least 95 Tibetans died from self-immolation, including monks, nuns, peasants, young students, and mothers, representing various societal classes in Tibet. “All they request are two things: freeing Tibet and allow Dalai Lama return to his homeland.” Tenzin Dolkar indicated that during the 60 years when the CCP controls the Tibetan area, there have been basically three modes of domination, i.e., military rule, colonial policies, and fear and intimidation. She supported the claim with numbers: the CCP deploys 500,000 police in the Tibetan area, making police to Tibetan people ratio 1:6 (assuming a Tibetan population of 3,000,000). In Ngawa of Sichuan province, the heart of the wave of self-immolations of ethnic Tibetans, 3oo monks in a temple went missing after being transported away by military trucks. The local Tibetans’ collective protest against troop’s persecution of young monks also faced military suppression.

Ann Noonan, Executive Director of Committee for U.S. International Broadcasting, stated that China’s reaction to the self-immolations exposed the true face of the regime – flooding Tibetan streets with troops, arresting protester staging peaceful gatherings, and banning tourists and journalists from Tibet, knowing that their reaction in unjustified. She said, the Chinese government is held responsible for the anti-humanitarian incidents all over Tibet and must allow independent investigators and journalists to report in the Tibetan area.

Jeremy Taylor, Executive Director of Free Burma Alliance, said that in the past year, there were 180,000 disputes between the government and its people over land acquisition. Many Han people, like Tibetans, set themselves on fire as a means of protest; some would resort to local U.S. consulate or embassy for relief, while Tibetans don’t even have such access.

Former Tian’anmen Movement leader, Wu’erkaixi said, “What is currently absent and needed in China is conscience and wakening of conscience. Witnessing these self-immolations without any reactions from China is a proof of lack of conscience. It is indifference.”

NYS Senator Rev. Ruben Diaz also submitted his statement, which was read by the president of U.S. Visual Artists Association. He expressed his puzzlement and rage of CCP’s anti-humanitarian treatment of the Tibetan people. He once met His Holiness the Dalai Lama and understood Tibetan people’s yearning for peace while the CCP’s denigrating the image of the Dalai Lama. Due to persecution of the Chinese government, there have been more than 94 ethnic Tibetan self-immolation protests. He also mentioned three examples of non-violent protesters, Gandhi from India, Dr. Martin Luther King, Jr. during the Civil Rights Movement, and the Vietnamese Buddhist monk Thich Quang Duc who set himself on fire in 1963. He stood in Solidarity with Tibet and prayed that China’s government would defend the principles and purposes of the Charter of the United Nations and give freedom to its people.

Zhang Jing, Director of Women’s Rights in China, indicated that the self-immolation protests were the most tragic rights defending incidents among all of both Tibetan and other ethnic groups in China in recent years. This is not only a political economic problem between governments and states, but also a universal value issue of human rights. The protests were the last resort the people chose after a prolonged combat against authoritarianism and corruption. They chose to sacrifice their lives in an attempt to awaken the government and officials’ conscience, after repetitive failure of communication with them.

At closing of the meeting, about 50 participants read “Song for Human Rights Fighters” with candles in their hands, hoping to light up the darkness in China with freedom and democracy.

五童陈尸案政府忙封口 李元龙被失踪

贵州毕节市2012年11月16五个孩子活活闷死街头垃圾箱事件,当地政府为遮丑,采取一系列“封口”措施,企图掩人耳目,使得事件更加复杂化。

 

北京时间11月21日,《新京报》、《南方周末》等等媒体去到毕节,准备与披露该事件的前毕节日报记者、中国妇权义工李元龙先生一起,前往事发地采访五童陈尸案有关案情,但是毕节当地政府不仅迅速将五个失去孩子的家长控制起来,还把记者全被堵在外面,不准采访。

 

贵州省毕节市公安再三警告向社会披露此一事件的李元龙,并禁止他接受媒体采访,要求他停止发布消息。今天早晨(2012年11月21日)中午12点40分左右,李元龙夫妇一同被公安人员抓去“旅游”,至今音讯全无。

 

案件回放:

2012年11月16日的贵州省毕节市,五个流浪儿童钻进贵州省毕节市环东路,垃圾箱避寒,被闷死。

 

17日早上8点来钟,李元龙先生来到毕节市七星关区流仓桥办事处的出事地点,他看到,距离办事处二十来米的环东路路边人行道上,有两个绿色、白色相间的,可以封闭的垃圾箱。垃圾箱约莫一米五长,一米三宽。据好几个环卫工人以及当地人说,为避寒而被活活闷死的五人都是男孩,最大的十三、四岁,最小的才七、八岁,或许更小一些。

 

垃圾箱放在人行道上,人行道边上是一个拆迁工地。据说,孩子们在拆迁工地围墙里面,用一些写有广告语的塑料篷布、水泥砖和三合板围起来,并在里面住了好几天。有目击者说,他还看见几个孩子曾经在垃圾箱里捡到一个破旧的皮球,在拆迁工地围墙里玩耍。16号清晨,是一个捡垃圾的老太太发现五个孩子死在垃圾箱里的。据说,老太太发现孩子的时候,孩子们都口吐白沫,当时其中两个孩子似乎还有一点气息。据说,流仓办事处和派出所来看了现场,并做了记录。

 

走进拆迁工地,李元龙看到,孩子们身前搭起的简单窝棚,但已经倒下,塑料布和三合板还在。李元龙等人一起找不到人们说的那个皮球,但看到了一块羽毛球拍,这一定是他们身前曾经喜欢的“运动器械”。

 

据说,为了能够更好保暖,他们将垃圾箱盖子关上。那种垃圾箱,大约一米五见方。

 

孩子们是谁家的?从哪里来?为何要在街头避寒?至少17日时一般民众还不知情,当地政府连日来也没有公布任何有关孩子们的背景情况。

我是安徽省无为县无城镇王福大队新村自然村村民,我叫曹永忠,今年33岁,在山东滕州摆了个烤鸭摊子卖烤鸭。我的妻子叫张荣花,今年30岁,我们有一个女儿,10岁了。今年10月2号,我妻子进了山东省滕州市妇幼保健院待产,下午她和我一起走进医院的,办理了住院手续,准备生小孩。第二天凌晨2点,我妻子进入产房,我要进去陪同,医生问我要钱,我身上钱不够,就没进去了。检查都是一切正常,没有任何的慢性病和心脏病什么的。准备顺产。大约1个小时。医生出来说她心跳稍微有点慢,建议剖腹产。我就同意了,并且签了字。然后我和医生把她从8楼的产房推到了9楼的手术室。那个时候我的妻子肚子已经很疼,到达手术室门口的时候,医生坚决不让我进去。过了几分钟我就发现。他们根本就没有在抢救我的妻子,而是在不停地往里面搬各种设备和器材,足足十多分钟,期间我的妻子不停地大声叫唤!我急得要命,几次跪下求医生赶紧抢救,终于等医生搬完东西了,开始抢救,我就听到里面的各种警报器,不停地响,不停地响… 大约20分钟后,里面恢复了平静。我还以为手术结束了,等着抱孩子!这时一个医生过来,把我拉到了旁边的会议室。告诉我,我的妻子和孩子都死了!

 

我当时彻底呆了!我转身往手术室跑,这时医生一个都走了,来了十几个保安,不让我进去。 大约几个小时后,我看见了我的妻子,她躺在手术台上,没有剖腹产,全身严重发紫,肚子涨的很大,脸上肿的变了形,活活被憋死了!一尸两命啊!一尸两命啊!!惨不忍睹…

 

之后,医院没有任何人,也没有任何解释,就把我的妻子扔在手术台上不管。血水躺了一地,我和父母向医院讨说法,医院推卸责任,说和他们无关,然后叫保安看着我们,不让我们去找医院,我的爸爸还被保安推伤了。。

 

10月4号,医院还不给说法,这个时候,我的妻子在手术台上已经30个小时了,全身开始淌尸水了!我和家人跪在医院门口讨说法。下午的时候医院喊我们上楼,说开会协商,还说来了领导,开始说是卫生局的,后来又说是派出所的所长,然后又来了几个人,说是市里的大领导。开会的内容就是说,我妻子的死和他们没有任何关系,他们出于人道主义,可以给我3万块钱,但是要我们立刻火化尸体,不然公安局就要强制执行!!我不同意。这个时候一个姓霍的领导。自称是政法委什么主任,我没听清,我看到他工作证上写的是5星级法官!!!他对我说:“你可以去告!在滕州,我天不怕,地不怕”!还说他在我们的老家芜湖也有同学在市里当领导,全国好多地方都有朋友。旁边的几个穿警服的人说,要是我敢闹事,马上就把我关起来!我说我要去找媒体,这时一个领导使劲的拍了桌子,站了起来,骂我,叫我马上滚,说媒体也是他们的媒体!因为当时有好多的公安,城管,还有没穿制服的几十人,我怕被他们抓了,所以就没敢赔偿,就把我的妻子运到了殡仪馆冻起来了,这时我的妻子全身都有刺鼻的气味了……

 

现在已经6天了,我的妻子还躺在冷冻箱里,一天需要219块钱才能冷冻,我是在滕州安居小区路边摆小摊卖烤鸭的,除了我女儿的学费什么的,一天真的剩不了几个钱!我现在已经无路可走!打电话给当地媒体,也没人来,,路边卖菜的好心邻居告诉我说,叫我和父母去市委跪着申冤……可是我们就几个人,要是我被抓了的话,我父母怎么办?我女儿怎么办啊?我父母今年都60多了,真的受不了打击了!我母亲现在天天坐在门口带着我女儿哭…… 医院和所谓的工作组什么都不管,连我妻子的冷冻费都不出!!我要求尸检,工作组只同意在本地几个他们指定的地方尸检!而且还要我掏各种费用!我哪来这么多钱?这和土匪做法有什么区别吗?

我以上所说的,天地良心,如有半句假话,天打雷劈。

From October 20 – 26, WRIC volunteers visited Ding Yuan in Chu Zhou to investigate the enforcement of the PRC’s new pledge to stop their practice of forced abortion. Ding Yuan is the hometown of Li Keqiang, who is expected to be the Premier of the State Council of the People’s Republic of China. As WRIC volunteers passed through villages in China, villagers talked of this prospective Premier with enthusiasm.  Discussions about politics in China are commonplace even in the villages. However, when it comes to the implementation of China’s one child policy, local and national authorities show no humanity.  In July, along with six other working priorities on their list, China’s National Population and Family Planning Commission delivered a report calling for an end to late-term induced labor (abortion). All local government officials at the conference expressed their willingness to follow the spirit of the conference. However, one Party Branch Secretary from the PRC’s Basic Level told our WRIC’s volunteers that they never heard such a speech nor regulation.  In that village, since June, three women have been forcibly aborted. Apparently, there is an unequal partnership between Local and Central Government making the PRC’s Central Government, with its focus on imposing top-down solutions, unaware that what is ordered by them is not carried out locally. If steps are not defined in the government’s priority area, the program will not be carried out properly or thoroughly. For example, although the PRC Constitution guarantees freedom of speech, the PRC’s government often harasses, arrests, and imprisons those independent scholars, netizens, and artists who are critical of the state system or government’s policies.  China dissident and Nobel Peace Prize winner Liu Xiaobo remains locked up. Because the PRC’s Central government endorses, acquiesces, underplays and withholds the civil responsibility of those murders, they do not take the laws seriously. The situation is worse in China’s family planning system.

New Forced Abortion Tragedy in Shandong Province

The June 2012 forced abortion cases in Ankang, Shaanxi and Changsha, Hunan brought international condemnation by the US Congress and the European Parliament of the PRC’s inhumane One-Child Policy. In July, the Chairman of the Chinese National Family Planning Committee ordered moderation of the policy’s implementation. Sensational tragedies of forced abortions had abated somewhat as a result. Instead the emphasis had transferred to heavy fines on “illegal births” which include giving birth without a permit or assigned quota. On August 2, WRIC was informed of Xu Li, a six-months pregnant woman in Wuyi, Zhejiang who was jailed and threatened with forced abortion. Ms. Xu, who was carrying her second child, daringly escaped custody before borrowing 90,000 yuan from relatives to pay part of the 150,000 yuan “Social Welfare” fine. Ms. Xu told WRIC volunteers via phone that her whole family’s entire annual income fell well short of the 60,000 yuan fine which is still outstanding. On average, “Social Welfare Fees” are 6 to 10 times the family annual income of ordinary residents.

On October 2, officials kidnapped Ms. Song, from Qiaojia Village, Heilizhai Township of Zibo City, Shandong Province who was six months pregnant. Seven Family Planning agents took Ms. Song, who was at home alone around 5pm. She was driven over hundred kilometers to Dongying City’s Boai Women’s Hospital, a private-run for-profit business for an abortion. During this ordeal, Ms. Song was stripped by PRC Family Planning officials and bound with ropes. Her cell phone was confiscated. After she was sedated, Ms. Song was finger printed on the abortion consent form to give “consent.” After the procedure she was jailed inside her hospital room. At 11pm that night, Ms. Song’s family finally found her in Boai Hospital after the abortion, lying naked in the hospital bed.

Local Government Unaware of Central Government’s Tone

Qingshan Village in Dingyuan County is remote hill-and-valley country, where communication is difficult and transportation, not easy. More than a dozen residential groups occupy this village. Residential groups range from tens of families to several dozens. Most of the younger labor force works outside of the province as migrant workers. Mr. Li, the Village Party Chairman told WRIC volunteer that five babies were born in his residential group, one girl and four boys. Most young women from the village were working in the coastal Zhejiang Province, where private ultrasound clinics proliferated. If a baby girl was detected during the pregnancy, then she would be terminated through abortion. Strict enforcement of the PRC Family Planning Policy does not allow expectant women to check into hospitals outside of their home counties. Village officials try to persuade women carrying “illegal” pregnancies to leave. If the women are found out, Township officials will arrest them to force abortions on them. The PRC Family Planning Commission actually set up a reward system. A person who informed on a woman carrying a second child could receive a 500 yuan reward. Informing on a woman carrying a third child meant a 1000 yuan reward. “Illegal” extra-quota births would cost the Village Chairman and the PRC Family Planning official 50 yuan each (out of a 500 yuan monthly salary) plus additional punishments during promotions and yearly bonuses.

Asked by WRIC volunteers about the PRC Central Government’s pronouncement forbidding forced abortions, Mr. Li said that he never knew of the decision nor any talk from higher levels of government. Li admitted that in the second half of 2012 alone, he participated in the arrest and force abortion of three women with “illegal” pregnancies.

Residency registration is one of the main venues of the PRC Family Planning Policy’s enforcement. “Illegal” children could not be registered. They could not enjoy social welfare or enter the public education system.

In relatively affluent Fanchang County, Anhui Province, kidnapping and forced abortions were relatively rare. Government propaganda enjoyed greater penetration. PRC Family Planning officials enjoyed richer benefits and rewards for detecting illegal pregnancies. Whenever suspicions fell on pregnant women and families, officials followed up closely. IUD implantation was mandatory after the first birth, forced sterilization after the second. Successful pregnancies of the third child were almost impossible. Illegal birth of the second child carried a fine of 100,000 yuan in Fanchang. Without paying the fine, the child could not be registered for citizenship, social benefits or schooling.

 Minister Wang Xia Defines the Priority of Work: Keeping Birth Rate Low

On July 19 and 20, 2012, the PRC’s National Population and Family Planning Commission held its semi-annual work conference on national population and family planning work, and Minister Wang Xia delivered a report in which she highlighted six priorities of work. First, unswervingly adhere to the PRC basic National Policy of Family Planning, and effectively stabilize the low birth rate as the primary task; Second, information construction to comprehensively address population issues as a breakthrough and an important starting point; Third, gradually improve laws and legal system; Fourth, strengthen family planning public service system; Fifth, promote large scale family planning projects, and large investment; Six, continue to uphold and improve management responsibility. The core message and central theme of Wang Xia’s speech gave every policy practitioner “the emperor’s sword”—a symbol of special authorization that forced abortion is not regarded as crime. Even though Wang Xia stressed to put an end to late-term induced labor, PRC Family Planning workers know that it is impossible to keep a low birth rate without practicing birth control policy strictly. In fact, at beginning of the year, it launched a nationwide large-scale recruitment of Family Planning workers to secure the practice of the Family Planning policy and the low birth rate nationwide. In February of 2012, Bi Jie in Gui Zhou province recruited 4271 Family Planning workers, 18 to 30 years old and  had college degrees.

Forced abortion and sterilization are similar in one way or another, but the consequences of exposing them and remaining silent are sometimes immensely different. Only a small number of women insist on filing lawsuits and appealing for their own reproductive rights against forced abortion, or even because of infection from the family planning surgeries; once their efforts are noticed by the society, local government will usually financially compensate them to some degree, as with the sensational case of Feng Jianmei in June of this year. Cao Ruyi, who was also almost forcibly aborted in June, attracted attention of US Congressman Chris Smith who subsequently sent a letter to enjoin relevant departments in Hunan to stop forced abortion on Cao’s 5 month-pregnancy. Cao hid herself with the help of WRIC volunteers until she delivered a healthy boy on October 15. She and her family expressed great appreciation to those who concerned about and supported her.

However, these lucky cases of Chinese women are rare while the majority of them can’t achieve their goal after a prolonged resistance. At 3:00am on October 20, 2012, resident of Sanhong Village, Longkou County, Honghu, Hubei, Zhang Wenfang, who was then petitioning as a victim of forced abortion in Beijing, was detained by policemen of Yangqiao police station of the Public Security Bureau of Fengtai District at the notorious “Jiu Jing Zhuang,” a private jail. She was not a suspect and did not even commit any crime, but all she got was an unprovoked deprivation of freedom instead of a solution to her hardship. This is of course not her first time of such suffering and is believed to be not the last if she insists on appealing. Nie Lina (Her photos of being forcibly dragged by several male officials at 6-month pregnancy have been posted widely on the Internet.), a very brave human right activist, was detained and kidnapped from her pregnancy to delivery to prevent her from petitioning in Beijing, thus harming the societal “harmony.” In October 2012, she was again detained by Beijing and Henan police force and her one-year-old child had to be jailed with her mother for several times. When the baby was 3 months old, she and her mother were put into a car in a jail in Beijing and then abandoned in the wilderness. On this freezing night, bearing great cold and hunger, Nie Lina and her daughter were finally saved. She would still try hard to hold back her tearing recounting the incident to Zhang Jing, Director of WRIC, on the phone. As of October 2012, the daughter of Nie Lina is the youngest detained petitioner in China on record.

Throughout the regions WRIC volunteers visited, the overwhelming impression was that the PRC Local Rural Family Planning authorities failed to receive or implement new policy directives. Old violent enforcement methods were still in practice. Women were still robbed of their rights to reproduction. Their sufferings from forced abortions and forced sterilizations continued. Their families faced astronomical fines levied by local governments.

Notably, more and more scholars are realizing that the major demographic problem in China is no longer population increase but low birth rate, population aging and gender imbalance. The October 26 2012 Report, Population Change and Adjustment in Population Policy, issued by the China Development Research Fund, collected opinions from more than 20 scholars. The report did not mention the Family Planning Policy’s human rights violations or the psychological suffering of the victims and their family. Neither did the researchers risk official suppression like long time intellectual opponents to the Family Planning Policy such as Yang Zhizhu. However, the Development Fund report was in stark contrast with National Family Planning Commission Chair Wang Xia’s talk in July of “Family Planning Policy as unshakable national policy”.

2012年10月20日至26日,中國婦權(WRIC)義工在安徽省滁州市定遠縣進行走訪,了解中央政府有關杜絕強制墮胎的執行情況。定遠縣是盛傳即將接任中國國務院總理李克強的故鄉,義工所到的村莊都能聽到村民們津津樂道的談論這位準總理,政治氣氛相當濃厚。但是作為中國國策的計劃生育政策落實人性化則是另外一番境況,今年7月中國國家人口計生委發文,各地方政府紛紛學習領導講話精神,除了強調計生6項首要重點工作,也提及了杜絕大月份孕婦強制引產。一名基層黨支部書記對WRIC義工說:沒有聽說過有這樣的講話或規定…,他說村裡有一個村民組,今年(2012年)6、7月份以來(至今3 、4個月)就強行拉了三名婦女去流產。顯然,中央政府說的一套和基層執行的一套落差甚大,中央沒有列入首要任務,農村基層就我行我素,就像中國憲法中明文規定人民有言論自由,但凡是質疑社會制度和政府政策的學者、網民、藝術家都不同程度遭受當地官員的嚴厲打壓、騷擾和軟禁,諾貝爾和平獎得主至今囚禁監獄,而中央管理高層的支持、默認、輕描淡寫或不積極追究執行者的民事刑事責任,是導致有法不依的主因。政府計劃生育系統中這類問題尤其明顯。

山東又現強制引產慘案

今年(2012年)6月陝西安康和湖南長沙強制墮胎等慘案接連發生,引發國際嘩然,美國國會以及歐洲議會一致譴責中國非人道強制流產政策。 7月,中國國家人口計生委主任發表了講話,各省市見風頭火勢也下達或重申了相關規定,醜聞案發生地的強制墮胎或引產現象有所收斂,轉而對非法生育的婦女以及其家庭課以嚴厲和巨額的經濟罰款,婚後未領取準生證、不按規定的時間提前懷孕或生育的家庭,都必須承受巨額罰款,更不用說生育二胎以上的家庭。 8月2日浙江武義農婦徐麗懷孕6個月被關押,面臨遭當地政府強制流產,懷第二胎的徐麗趁看管人員不留意勇敢地成功逃跑,稍後向親友借了9萬元人民幣繳交了一部分“社會撫養費”,她接到的繳費通知規定一共是15萬元人民幣(約2.42萬美金),徐麗還必須再交6萬元才能過關。徐麗親友在電話中對WRIC義工說,她們家一整年收入就算不吃不喝也交不起這麼多的罰款。一般規定須繳交的“社會撫養費”是非法生育家庭年總收入的6至10倍,但由於各地居民、農民的收入不一樣,而各家庭被當地計生官員認定的收入也不一樣,因此繳納的“社會撫養費”根本沒有統一標準。

2012年10月在山東淄博市黑裡寨鎮喬家村又發生大月份強制引產案件,村民喬平安妻子宋某計劃外懷孕6個月,2日下午約5點,七名計生人員將獨自在家的宋某強行架入車內,驅車從淄博趕往幾百公里外的東營博愛婦科醫院(當地一私營醫院)強制注射引產針。在這過程中,鎮政府及計生辦工作人員對該孕婦進行捆綁,搶奪手機,使用暴力手段非法拘禁限制人身自由,為防止其反抗,還採用侮辱手段將宋某衣服扒光,強行打麻藥並強制在流產通知書上簽字按手印。事後為阻止其反抗逃跑,醫院及鎮政府工作人員將其反鎖在醫院病房內。當晚11點左右家人經四處打聽後,趕到東營博愛婦科醫院時,孕婦已被注射催產針,裸身躺在醫院病床上,10月5日晚,孕婦在東營博愛婦科醫院產下一死嬰。

基層不知中央精神

定遠縣西卅店鎮青山村地處定遠縣西部,與鳳陽、長豐、肥東接壤,半山半圩,交通極為不便,全村有十幾個村民組,一個村民組一般少的有10多戶家庭,大的有幾十戶,大多青壯年都在外省打工,村委黨支部書記李xx告訴WRIC義工,他所居住的這個組今年(2012年10月止)一共新生了5個孩子,4個男孩,只有一個是女孩,這都是因為孕婦們大多在淅江一帶打工,那邊私人做B超很多,為了能生男孩,很多人都採取孕期做B超的方法,發現胎兒是女嬰後便做人工流產。因為計劃生育政策非常嚴厲,孕婦臨產時在外地進不了醫院,回到家中後,村官說他們一般會採取勸其離開,一旦沒走成或被發現,鎮計生辦會將其抓去流產,計生辦對此還實行獎勵政策,即舉報一個計劃外二胎的,獎勵500元,三胎的獎勵1000元,發現計劃外生下來的,扣書記和計生專幹各50元(書記每月只有500元工資),並且也會影響到年終獎勵和以後升職。

WRIC義工問及中央政府有關禁止強制引產規定的執行情況時,李xx居然說根本不知道有這樣的規定,也不知道中央高層相關講話。他坦承,僅今年(2012年)下半年,他就親自參與抓了同一個村民組裡的3個非法懷孕的婦女去做了強制流產。目前3個婦女中有的加入了農民工大潮,去了外地打工。

控制戶口也是執行計生的主要手段之一,在政府規定的“計劃外”出生的孩子,從一出生起就失去“社會人”的權利,他們沒有戶口,即沒有享受社會福利、受教育等等權利,不過中國政府延續了至少2000多年的“戶籍”制度,對生育控制確實也起到了阻嚇作用,人們因無錢繳付高額的罰款和擔心孩子將來的生活,常常會被迫選擇“自願”墮胎或流產。其實這種“自願”行為是一種表面現象,農村家庭基本上就是為了避免巨額罰款而被迫做出選擇,而城鎮居民更恐懼的則是戶口問題。

較為富裕的安徽省蕪湖市繁昌縣的計生情況,相對來說較少發生“慘案”。婦權義工在當地了解情況時發現,這一帶一般家庭收入較高,宣導工作也細緻,該地區重男輕女的傳統觀念不如其它地區嚴重;另外就是計生人員的待遇相對較好,其計劃生育工作做得非常嚴謹,抓到非法懷孕強制其流產成功後,所得的獎金獎勵很高,因此只要懷疑有非法懷孕婦女和超生家庭,計生人員就用盡各種方法緊盯不放,一胎上環、二胎結紮,很少出現成功生育第三胎的現象。繁昌縣規定,超生二胎的須罰10萬人民幣,如果拿不出錢,孩子就上不了戶口,沒有戶口就意味著孩子將來都無法上學、不能享受任何社會福利。

王俠首重維持低生育

7月19至20日,國家人口計生委在北京召開了2012年全國人口和計劃生育半年工作會議。國家人口計生委主任王俠提出目前迫切需要做好的六項重點工作。一是始終堅持計劃生育基本國策不動搖,切實把穩定低生育水平這一首要任務抓緊抓好;二是把人口信息化建設作為統籌解決人口問題的突破口和重要抓手;三是逐步完善法律法規和政策體系;四是加強人口計生公共服務體系建設;五是抓緊研究謀劃促進人口計生事業發展的大項目、大投入;六是繼續堅持和完善目標管理責任制。為了實現王俠要求的重點工作中的首要任務,即堅持計生基本國策不動搖,穩定低生育水平,基層執行官員便有了“上方寶劍”,對非法懷孕婦女採取強制墮胎手段並不會負擔法律責任,加上各省市、地區計生部門在學習王俠講話精神的宣傳系統裡,基本忽略“杜絕大月份引產”,因為官員們都清楚,要穩定低生育水平,就難以做到“杜絕引產” 。事實上,早在今年初就展開了全國范圍內的大規模招聘計生特崗工作人員,加強查處黨的計劃外懷孕、生育的婦女,以保障“堅持計生國策不動搖,穩定低生育水平”,僅貴州省一個縣級市的畢節市2012年2月就公開招聘了4271名鄉村人口計生特崗工作人員,資格是中專以上學歷,年齡在18以上30歲以下。

強制流產或墮胎、結紮過程大同小異,但敢於向社會披露或保持沉默的結果有時相差甚遠。為維護自己生育權益,反抗遭強制墮胎,甚至因計生手術感染並發症的婦女堅持控告、上訪的為數不多,她們的努力一旦獲得社會普遍關注,地方政府往往會給予一定經濟補償,如今年6月引起轟動的馮建梅案等。2012年6月險遭強制流產的曹如意,獲得美國國會史密斯議員關注,去函湖南省市各級部門,強烈要求停止對懷孕5個多月的曹如意進行流產,曹如意在中國婦權義工協助下躲藏起來,直至10月15日順利誕下一名健康的胖小子,她和家人對所有關心和支持的他們的人表示非常感謝。

但如此幸運的中國婦女極為罕見,更多的是就算曠日持久的反抗也基本達不成自己的願望。
2012年10月20日凌晨3點正在北京上訪的遭強制墮胎至殘的受害人、湖北省洪湖市龍口鎮三紅村村民張文芳被丰台區公安分局洋橋派出所警察深夜帶進收容所(臭名昭著的私營黑監獄“久敬莊”),她不是疑犯,更沒有犯罪,她不但得不到任何解決方案,還無端失去自由,當然這不是她的第一次,只要她繼續控告,相信也不是她的最後一次。聶麗娜(她懷孕6個月時被幾名男官員當眾拖行的照片在網上流傳),一位勇敢的維權婦女,從懷孕到女兒出生歷經被拘禁、攔截、綁架、黑頭套,理由就是不准到北京上訪維權,影響“和諧”,2012年10月再次被北京和河南警方先後關押,她僅一歲的女兒也隨母親多次坐牢。小女孩3個月時和母親一起被人半夜從北京的拘留所裡推進一輛車裡,再扔到一個荒野郊外,這是一個寒冷的夜晚,母女飢寒交迫,聶麗娜獲救後在電話上告訴中國婦權負責人張菁,依然難忍淚流。據訪民記錄,截至2012年10月聶麗娜的女兒是中國年齡最小的被關押訪民。

WRIC義工所走訪的地區,最深刻的印象是,農村基層計生政策不僅沒有收到或實施新的法規,舊的強制手段也依然執行,婦女依舊被奪去與生俱有的生育權利,遭受著強制流產、強制結紮的痛苦,她們的家庭更要應對來自於當地政府的巨額罰款。事實上,無論是中國婦女所謂的“自願”行為,還是“非法超生”,她們大多做了沉默一族,並在數十年的強制政策中漸漸習慣了這種被迫放棄自己的基本權利的模式,她們相信,對抗共產黨的國策,後果十分嚴重,代價極大難以想像。

不過值得一提的是,越來越多的專家學者認識到,中國人口的主要矛盾已經不再是增長過快,而是人口紅利消失、臨近超低生育率水平、人口老齡化、出生性別比失調等問題,應該實施“生育自主、倡導節制、素質優先、全面發展”的新人口政策,建議2015年全面開放二胎政策。
2012年10月26日中國發展研究基金會發布的《人口形勢的變化和人口政策的調整》報告就收集了這20多位學者的建議,儘管這些建議中並沒有涉及中國強制性計生政策嚴重侵犯基本人權的案例,沒有分析這項政策對婦女和她們的家庭成員帶來的身心傷害和社會效應,他們也不像一些長期關注中國暴力計生問題的知識分子(楊支柱等)那樣飽受官方打壓,但畢竟與國家計生委主任王俠7月定下的首要重點工作“堅持計劃生育國策不動搖,切實穩定低生育水平”講話相去甚遠。如果真的實現開放二胎,我們相信,中國計生基本國策已開始動搖,數億婦女慘烈的被強制流產、墮胎、結育痛楚將得到緩解。

為什麼是歷史謎團?

1959年3月達賴喇嘛出走事件,海內外有多個版本流傳。在中國有「民間版」和「官方版」兩個主要版本。「民間版」即「讓路說」:當年達賴喇嘛出走
印度,是毛澤東放走的。「官方版」則是「劫持說」,這個說法首見於1959年3月28日發布的《新華社關於西藏叛亂事件的公報》:「這些反動分子……在3
月17日悍然將達賴喇嘛劫出拉薩。」儘管達賴喇嘛隨即發表聲明公開否認,但官方一直堅持這個說法。這兩個版本至今還在流傳。

對於達賴喇嘛出走的原因,書中的陳述是3月17日那天有兩發砲彈落在羅布林卡,在請示乃穹神諭後,得到的指示「快走!快走!今晚就走!」神志迷狂的神諭抓起紙筆,清楚地畫出一張路線圖。

但乃穹神諭的話只是達賴喇嘛考慮的因素之一,那兩發射向羅布林卡的砲彈才是促使他做出決定的主要原因。

他相信,如果民眾不再有保護的目標,他們很快會離開羅布林卡,自行解散。他希望以這樣的方式來避免大規模流血。

歷史不會說謊,歷史不能迴避,是時間的最好見證

我們必須重新審視1959年的事件,弄清楚1959年3月,拉薩到底發生了什麼,否則永遠不會理解藏民族的傷痛,也永遠無法理解為什麼每隔20年左右,西藏就會出現暴動。

本書附有數十幅珍貴的歷史圖片,是最好的歷史知識教育。

目前河南襄城县关押着中国年龄最小的访民—-仅满周岁的圆圆,这是圆圆与母亲聂丽娜第三次被关进河南襄城拘留所。中国妇权组织义工拨打了襄城县县委书记苏建涛和襄城县政法委书记王喜建等人的电话,但无人接听。两周前即2012年9月17日晚上10点30分,河南维权人士聂丽娜在北京的住处,突然冲进去10余名公安人员,在住处内搜查,同时强制要求所有大人小孩都不能离开这所房子,勒令聂丽娜交出手机、不允许打电话报信等,正在熟睡中、刚满周岁的女儿圆圆被惊醒。接着警察勒令聂丽娜带着孩子上警车,连人带用品就这样被迫黑夜离开住所,中国最小访民圆圆被北京警方非法关押后,辗转送往河南襄城拘留所,至今半个月仍在关押。

被多次关押的聂丽娜一再强调:自己上访是合法行为、在京没有违法、没有案件,京警黑天半夜、秘密强行入宅、不出示任何法律手续、是没有权利限制人身自由的。但是,这晚聂丽娜和刚满周岁的小访民圆圆,还是被10多名京警从住处强行带到了:北京市公安局昌平区南口派出所。自此,聂丽娜母女与外界失去了联系。直到三天后家人才从熟人处获悉:聂丽娜和刚满周岁的小访民圆圆,当晚就被北京警方移交给河南驻京办,又由河南襄城警方连夜用汽车强制押送到:河南襄城县,关进了襄城拘留所。

据了知情者介绍情况说:前两次被关押在河南襄城拘留所里, 只有几个月大的婴儿圆圆,没有奶吃、没有医药,由于饥饿和疾病,得了严重的营养不良症,病了也没有人管、得不到治疗,瘦了许多,叫人看了十分伤心。

这次,这个全世界最小的婴幼儿访民圆圆,又第三次被非法关押进了河南襄城拘留所,已经两周时间。令所有知情者感到愤慨!众人谴责:这种缺失人性、关押婴幼儿的违法行为!这种犯罪行为一再发生,并且每次都有京警的秘密配合,关押后无吃无喝、有病不给医治,利用限制人身自由虐待受害者,其残忍程度令世界“晕倒”。

访民反映:我们进京维权、上访,是相信国家首脑、中央会主持公道。来到中央所在地北京,能找寻到青天、正义、公平。京警都胡来,与地方警察勾结一起、乱抓无辜,上下一样黑暗,上访看来没有出路。不少在京的维权人士表示:这是北京警方和地方警方执法犯法——“联合截访”造成的、令人发指的、叫人不可饶恕的犯罪行为。

北京的部分维权人士从事实和法律两个角度表述了对抓捕在京维权人士聂丽娜和周岁圆圆的看法。

一,从事实看:京警介入非法搜查民宅和非法关押在京维权人士、访民 这种做法,可以看出:“联合截访”,明暗配合,秘密抓捕,不是解决上访问题的良策,而是破坏社会和谐、制造社会不稳定因素的根源。

北京警察,利用“便衣”秘密跟踪、秘密抓捕维权人士、对守法上访的公民下“黑手”、使用“暗招”,不仅带头破坏了上访政策、而且给政府造成恶劣影响。例如:非法关押聂丽娜和周岁圆圆的事情,虽然只发生在一个哺乳期妇女和一个婴幼儿身上,但是,使成千上万在京上访、维权的群众看到了:中国政府是说一套、做一套。政府设立的上访窗口,表面上是叫人民群众“说话”的,可是“说话”之后,又叫警察给:非法关押、甚至劳教、判刑了,这种结果使上访者认为,政策与现实是“两回事”,大陆没有人权可言,上访前途——暗无天日。

二,从法律根据上看,京警和河南警方“联合截访“,秘密抓捕聂丽娜和周岁婴幼儿圆圆,违反了我国《宪法》和《刑法》。

根据《中华人民共和国宪法》第三十五条、三十七条、四十八条之规定:中华人民共和国公民有言论、出版、集会、结社、游行、示威的自由。公民的人身自由不受侵犯。任何公民,非经人民检察院批准或者决定或者人民法院决定,禁止非法拘禁和以其他方法非法剥夺或者限制公民的人身自由。妇女在政治、经济、文化、社会方面权利应受优先保护。

京警和河南警方在维权人士聂丽娜无违法、无犯罪事实情况下,违背法律程序,非法拘押聂丽娜和周岁圆圆,显系滥用公权、侵害了妇女儿童的合法利益,严重践踏了我国《宪法》和《刑法》,严重侵害了两位公民的人身权利,特别在非法关押周岁婴幼儿,是一种既不人道、又执法犯法的暴行,是严重的犯罪行为!

事情发生后,在京的很多维权人士联合签名,强烈谴责河南警方非法关押周岁婴幼儿圆圆的犯罪暴行,要求河南警方立即无条件释放世界上最小访民圆圆,并要求河南襄城警方立即无条件释放小圆圆和母亲,对相关责任人作出公开法律处理,以平民愤。

中国妇权呼吁社会关注聂丽娜母女基本权益,对哺乳期妇女聂丽娜和周岁女儿圆圆,提供律师、医疗等紧急援助。

一个遭遇嚴重家庭暴力的农妇,用她一双残疾的手,忍受着巨大的痛苦,一字一字将自己的悲惨遭遇发到网上求救,恳求网友帮她在网上申冤,这是一起血泪的控诉,她說,临终前也要讨回一个公道。

为了揭开真相,声援受害妇女,《乐讯手机》网友、中国公民维权联盟义工天理和中国妇权义工苏昌兰女士等,2012年9月19日一起来到广东惠来县探访了受害者吴木琴,并求证了这起残酷家庭暴力案,访谈中,受害人的悲惨处境让在场网友动容,禁不住感伤落泪。

母子遭遗弃  患病虐待逼离婚

32岁的女受害人吴木琴住广东省揭阳市惠来县东陇镇赤洲管区蔡厝巷4号。2001年与本村村民林木辉结婚。由于产子时没有调理好身子,患上了严重的风湿
病,生活不能完全自理,她不但常遭公婆谩骂羞辱,丈夫林木辉更是动辄就拳脚相向,她在双重虐待中只能隐忍。2年后,林木辉终于将身患重病的吴木琴和两岁的
儿子遗弃在老屋,他自己与父母搬到了别处居住并开了一间工厂。

2003年,为了抛开吴木琴这个“累赘”,林木辉迫吴木琴与其离婚,并如愿以偿。离婚如雪上加霜,失去经济来源的吴木琴噩梦不断。2005年,吴木琴又病
又伤心半瘫痪在床、生活完全不能自理。没钱治病,自己连自己也照顾不了,孩子的生存更加成为问题,在万般无奈下,吴木琴只好将儿子托付给一个信得过的朋友
照料,自己则全靠年迈母亲帮助看医治病、饮食起居,生活非常清苦。林木辉不但未尽责负担赡养,对吴木琴的摧残也没有停止。2005年是吴木琴病得最利害的
时候,一天林木辉抱着躺在床上的吴木琴,要将她扔到门前外的小港河,要淹死吴木琴,后被村民看到并斥责其林木辉丧尽天良,吴木琴才得以脱险。

看到女儿的处境,心如刀割的母亲不断帮她四处寻医,2008年吴木琴病情开始稳定了,虽然吴木琴的生活还需要母亲照料,包括喂饭和大小便。但吴木琴在凄惨
的日子有母亲呵护,吴木琴终于一天天好转起来。可想不到的是,2010年其前夫林木辉与其父母又搬回来老家来居住,对吴木琴这个病人,更加视为眼中之钉,
肉中刺,不但要将她赶出家门,更欲除之而后快。

残害致断骨  凶手至今逍遥法外

2010年,吴木琴其丈夫林木辉指使其堂兄林木开来到吴木琴的房间,提起在床上养病的吴木琴,往床旁的地上重摔,之后,扬言要整死吴木琴的林木开,更惨无人道的将惨叫的吴木琴拖出房门口提往房门口的石块上连续摔了几次,直到将吴木琴摔到不能弹动为止。

林木开还口出狂言定要一次了結,拖起吴木琴要扔门外去!许多邻居目睹了这一幕,有的胁于其淫威,敢怒不敢言。但吴木琴的惨叫声引来了愈来愈多的邻居,林木开的母亲怕犯众怒才制止了林木开的疯狂暴行!

暴行发生后,吴木琴的弟弟带吴木琴到医院检查,医生检测出两边大腿连接的股骨处全骨折了,医生警告说,若不立既医治,将会造成终身瘫痪。由于吴木琴患病多
年,家空物净,没有钱做不了手术。在绝望中,与吴木琴同一病房中的一个病友帮吴木琴写了一份告状书,让人送到派出所要求给处理。谁知因为林木辉的一个亲戚
是原林业局局长和县共青团副书记、现任渔政局大队长的陈明坚,由于朝中有人,有关部门对该案的处理只是走走过场,当地的派出所还欺骗吴木琴说:“派出所已
经在网上通缉林木开了”!

吴木琴的娘家当时也就报了警,当地的派出所还立了案,但就是没抓到凶徒。可不久前,行凶者林木开的爷爷去世,林木开还在大摇大摆的去送葬。吴木琴的弟弟得
知这一情况后又去派出所报案、却遭到一帮人的暴打!有好心的民警告诉吴木琴的弟弟,凶手林木开根本没有在网上被通缉!

知道了真相的吴木琴当即气昏了过去。为了得到申冤,为了让恶魔绳诛于法,吴木琴于是用她那双变了型的手,用手机将自己的悲惨遭遇一小段一小段发到网上向网民求救……。

“天无绝人之路”,
吴木琴凭她那顽强求生意志,终于感动了《乐讯手机》的网友,网友纷纷捐款帮助吴木琴。2012年9月18日,中盟、中国妇权的义工及网友们一起来到揭阳市
惠来县东陇镇探望吴木琴,她所遭受的暴行激起人们的愤概!妇权义工表示,一个文明的社会,家暴不再是家庭事务,施暴者必须受到惩罚,受害者必须得到保护,
尤其是妇女儿童。义工和网友们鼓励吴木琴一定要有生存下去的勇气!要有信心维护自己的基本权益,也一定会看到凶徒绳之于法,讨还一个公道!

为了公义和良知,为了社会真正走向文明,这次探访的所见所闻公诸于世,探访受害人所拍摄的视频也将一并公布,让国内外网民、公众给一个公论!同时我们也将继续跟进法律援助的事宜。

2012 年09月12-13日,旨在反对并终止中国强制计划生育政策的美国民间机构“女童之声”(All Girls Allowed),发出英文版的新闻和代祷信,声称中国政府开始禁止强制堕胎和强制结扎。该消息经过一些媒体转发和报道,引起多方的反响,但多为质疑的声音。一些机构和专家已经进行了针对性的反驳,对华援助协会也在私下与该机构进行了深度沟通,明确表示了不同的看法。对此,女童之声及其创办人和负责人柴玲女士进行了辩解,坚持其新闻和调研的真实准确性。(参看本社论所附的部分相关新闻链接)

对华援助协会认为,尽管我们都 盼望中国的强制计划生育的邪恶政策早日终结,也尊敬和赞赏“女童之声”和柴玲女士在这一领域中的重要工作和贡献,但是,“女童之声”(AGA)这则新闻的论调及其结论,缺乏必要和足够的证据,过于天真,言之过早,属于报道失误,因此,严重误导和混淆了国际视听。同时,也在无意中配合了中国政府的舆论宣传,美化了计生委及其官员的形象,从而会伤害不计其数强制计生政策受害者的感情,并挫折他们追求公义和捍卫生命尊严的勇气。

“女童之声”所列举的证据主要有两个:

一、今年7月12日,“中国国家人口和计划生育委员会”召开2012年全国人口和计划生育半年工作会议,国家人口计生委主任王侠女士在报告中要求“引导群众自觉实行计划生育,坚决杜绝大月份引产,……”

二、”女童之声”给中国重庆市的计生官员打电话进行确认,得到肯定的答复说:中国政府已经给所有的计生委员会下发文件,禁止强制堕胎和结扎,必须由父母自愿决定。

因此,女童之声分析说,可见,国家计生委领导王侠在7月份的讲话并非虚言。重庆官员说:“再也不会有强制堕胎了。”

对 华援助协会认为,上述两个所谓的证据,不过是口头和打印在纸上的说法而已(甚至连文件还没有看到,只是听说),还没有任何实践和行动的证明。换而言之,这仍属于中国政府的宣传而已。因此,是不应当据此得出结论,认为中国政府已经开始禁止强制堕胎和强制结扎。原因如下:

一、不要轻信中国政府的宣传。中 国共产党政府从1944年至今的宣传,是以谎言为核心的,多用欺骗、误导、威逼利诱和洗脑的方式。根据1944年6月13日的《解放日报》报道,毛泽东在答中外记者团时说:“但是只有建立在言论出版集会结社的自由与民主选举政府的基础上面,才是有力的政治。”说得实在动听。而作为89年天安门学生运动的领袖柴玲女士,经历了那场大屠杀,应该比许多人更清楚这一点,也当更刻骨铭心。当时中央政府不是也说过“政府绝不秋后算账,政府不会对参与六四的学生搞政治迫害”,云云。但事实呢?此外,今年发生在重庆市的中国特色的爆炸性政治新闻,至少说明了一点——谁还敢相信重庆官员的话呢?还有,中国政府常年宣传,说中国公民享受充分的人权、言论结社自由、宗教自由,等等。然而,对华援助协会每年的基督教会遭受政府逼迫的年度报告中的大量事实数据,岂不是让这些谎言都 大诏于天下了吗?

二、国家计生委主任王侠在讲话中强调,要继续执行计划生育之国策。王侠的讲话的主要中心思想和基调是,30多年来的强制计生工作从来就是正确的。因此,“要认真总结人口计生工作成绩,进一步坚定信心和决心。”,并且,这是党国政府始终坚持的 路线,即“党中央、国务院始终坚持从战略和全局的高度认识和把握人口问题,特别是改革开放以来,始终坚持人口与发展综合决策,坚定不移实行计划生育基本国 策,”所以,“我国人口计生工作取得了举世瞩目的伟大成就。全国共少生4亿多人,……”注意,这里的4亿实在是血淋淋的数据。

三、事实胜于雄辩:根据近日中国大陆传来的消息,强制计生和强制堕胎仍在进行。自
从1979年开始的强制计划生育政策,已经造成了无数胎儿被强制流产,无数妇女被强制结扎,无数家庭因高额罚款和牵牛拆屋而流失失所,无数干部因所辖范围出现超生而被免职或降职,也有无数干部因血腥残忍执行计划生育政策而得到提升(例如,被视为迫害陈光诚的第一黑手、原临沂市委书记李群,现任青岛市委书记)。但是,中国的计划生育法和地方的计生条例中,从未提到允许强制堕胎和结扎的手段,但事实上,政府行为却一直毫不犹豫地从事强制堕胎和结扎。胡锦涛2011年01月访问美国时,众议院国际关系委员会主席佛罗里达州的议员伊莱亚娜•莱赫蒂宁 (Ileana Ros-Lehtinen)女士提出有关中国强制计划生育的问题,胡锦涛主席当场撒谎说:“中国不存在强制堕胎!“

四、和1989年镇压天安门学生运动一样,“计划生育国策”是中国共产党在邓小平时代重要的政治正确的指标。因 此,否定了“六四镇压”和“强制计生政策”,就等于承认了1979年之后中国共产党犯了严重的错误,就等于否定了邓小平。如果中国政府禁止了强制堕胎和强制结扎,靠父母自愿选择,那么计划生育的政策就会立刻破产。而这一天的到来,一定是中国政治出现重大变革,邓小平的政治时代遭到否定,正如邓小平时代的中共政府否定了毛泽东时代的“文化大革命”。至少,在召开日期还未定下来的今年中共18大之前,还没有任何理由可以这样乐观地认为。

综 合上述四个方面,我们认为,”女童之声”没有确凿的理由相信王侠在长篇大论中的那一句话会付诸实践,更没有根据认为重庆市官员的话就可以证明中国政府要禁止强制堕胎和结扎,尽管我们有理由相信这种宣传和说法确实已经发生,为的是应付国际上强大的压力和国内强烈的不满。这种措辞的变化当然是需要注意到并受到 鼓舞的,因为这说明国际压力和国内的计划生育维权活动已经产生效果。

众所周知,今年有几例关于强制计划生育丑闻的爆炸 性新闻,在国内和国际社会引发强烈反响和声讨。包括山东省临沂地区的盲人维权律师陈光诚先生出走美国事件、陕西省安康市冯建梅的7月胎儿被政府强制流产、福建省仙游县的8个月胎儿被政府强制流产、湖北省监利县胡霞近8个月的胎儿被政府强制流产,等等。还有湖南省长沙市怀孕5个月的曹如意女士被政府干部绑架 到医院欲实施强制流产,幸亏对华援助协会、中国家庭教会和国际社会的努力,特别是美国新泽西州的议员克里斯•史密斯(ChrisSmith)先生致信长沙政府抗议交涉,才得以幸免。

所以,中国政府舆论宣传的一部分变化,并不能代表会有实际的 变化。人们需要看到实际的行动,以及政策的事实性变化。然而,从王侠的讲话中,看不到有任何要禁止强制堕胎和结扎的动向,因为她还说:“一是始终坚持计划生育基本国策这个根本不动摇,切实把稳定低生育水平这一首要任务抓紧抓好。稳定低生育水平是坚持和落实计划生育基本国策的首要任务,……”这里强调了稳定生育水平是首要任务,即这项“不动摇”之基本国策的首要任务。但如何才能“坚持和落实”完成这项首要任务呢?靠着中国父母的自愿决定不生第二个孩子?没有人会相信,王侠也不例外。

下面,让我们引用中国共产党和政府的喉舌——新华社,在1946年对国民党政府的抨击言论:

“二 十年来,尤其是最近几年,我们天天见的是‘只许州官放火,不许百姓点灯。’政府所颁布的法令,其是否为人民着想,姑置不论。最使人愤慨的是连这样的法,政府并未遵守。政府天天要人民守法,而政府自己却天天违法。这样的作风,和民主二字相距十万八千里!所以民主云云者是真是假,我们卑之无甚高论,第一步先看政府所发的那些空头民主支票究竟兑现了百分之几?如果已经写在白纸上的黑字尚不能兑现,还有什么话可说?所以在政治协商会议开会以前,我们先要请把那些诺 言来兑现,从这一点起码应做的小事上,望政府示人民以大信。—《新华日报》1946年2月1日”

我们不禁要问,中国 共产党自1949年建国成立政府,到下个月就63年了,是否兑现了自己的诺言呢?国民党政府在台湾实现诺言已经20多年了。同理,国家人口计生委主任王侠 在今年7月份的会议中指示,要“坚决杜绝大月份引产”,那么,就让我们拭目以待,看何时才能实现这一点。

谎言不可怕,但轻易相信撒谎者并天真地传言,却是令人忧虑的。

鉴此,对华援助协会深表遗憾和不安,并强烈呼吁“女童之声”做出补充更正声明,以清视听。让我们团结起来,继续揭露强制计生政策的暴行,安慰并支持受害者勇敢地通过法律维护人类最基本的生育权,同时仰望主耶稣基督的恩典和帮助,早日终结这项祸国殃民的愚昧而邪恶的国策。

冯建梅案最新消息

为了帮助受害人冯建梅一家权益得到政府公平处理,中国妇权义工、学者偕同律师远道去陕西安康镇坪,但是受害人家属在政府的软硬兼施、恩威并济之下不敢委托或接受外来援助。

原本准备去碰硬钉子,很多随身用具包括电脑等都没有带,结果碰的却是橡皮钉子。不仅受害方的冯建梅家请吃饭,当地司法局也请“远道来客”吃饭,而在这两顿饭之前,一行人还被受害方冯建梅丈夫邀请,同代表地方政府的妇联、当地律师等一同吃饭。一名义工说:连连“被吃饭”我们似乎成了加害方、受害方共同暗中防患的镇坪“境外敌对势力”。

不过安康政府在中国妇权义工等离开前,已经处理了冯建梅的户口问题,冯由原先的内蒙古城镇户口已经牵进了当地的农村户口,也就是说,可以比照农村户口生二胎,冯家可以再生一个孩子,有义工感叹道,这是一个户口换一条命呀,半个月前官员相逼鸡飞狗跳,谋财不成害命,半个月后还是那些官员,冯建梅还是冯建梅、邓元吉还是邓元吉,不同的是可以明正严顺生孩子,还有官员陪同吃饭。

 

计划生育”新诠释:
什么是“计划生育”? 就是谋小康家庭的财,害穷人的命。

一方面,在大城市和富裕地区,计划生育政策多采用的是剥夺工作或罚款的办法对超生 者进行惩罚,很少采用强制堕胎的做法。对于那些富人,计划生育政策则往往根本起不到约束作用。他们或支付得起巨额罚款,或可以赴境外或香港生子。而另一方 面,在边远贫困地区和农村,超生家庭因付不起罚款,孕妇被拉去强制堕胎的事情时常发生,这次发生在陕西安康的事件就是一个典型的例子。、

  During the visit with friends to the Phoenix County of Tujia Minority Autonomous Prefecture in Hunan Province, I walked into a bachelor’s village named Xia Qian Tan when going to a mountain village which appeared in the TV play Oolong Hill Bandits for sightseeing.

Wu brothers, two single men, came from one of the bachelor families in the village. They were building their house when I went into the room. Short of money to pay wagers, all the building materials were carried uphill at their backs from the foot of the hill and built the house themselves. The elder brother told us that the house where they lived, whose walls had crumpled up many times, came down to them from their forefathers of more than seventy years ago. Not far away from the house, there was a huge cave, which reputed to be the quarter of the bandit chieftain: the King of Miao Minority. After the broadcast of the TV play Oolong Hill Bandits, The cave was transformed to a tourist attraction. Wu brothers had nothing but the bare walls in their house. However, they owned a 20-inch television set and an antenna with access to the TV satellite propped against the fieldstone walls. It is not hard to reason out what the motive of spending several thousand yuan to buy that TV set was: this TV set provided intellectual sustenance and dismissed the fear of loneliness.

Since their parents died at an early age, these brothers had to pull together and take care of each other. The elder brother has been 48 years old in this year. His young brother refused to tell his own age, but seemed 43 or 44 years old.  When asked the reason why they did not get married, they responded in one word: “poor”. They had a small piece of land covering only 1 mu and could hardly raise sufficient food to fill their own stomachs. Now and then, they earned a little money by doing odd jobs here and there. The elder brother never went to school and the younger brother only finished the third grade at an elementary school. With a strong accent but no skills, he could only stay in the village. His elder brother told us he could never find a wife and his hope was placed on his younger brother. He tried to scrimp and save to build a house, which, as what he expected, may help his younger brother find a wife. He believed that the women of today were material. If his younger brother had a new house, one widow might be willing to marry him. If things were going well, the wish of his heart would be accomplished and their parents would get final peace in their graves.

The younger brother had a robust constitution. With a several-day beard, his face had been bronzed by the sun. With the chat going on, the subject was changed to women. Different from his elder brother, the younger one did not like staying at home. He liked talking women with other single men. If they could afford it, they would go down in company to find prostitutes. The younger brother told me that there were plenty of prostitutes in the town. Women having good looking asked for 50 to 100 yuan but there were some only cost 20 to 30 yuan. Those single men always got together gossiping the death of someone’s husband, a new divorce of a woman or the price of a new-bought bride.

Honestly, I was not interested in these single men’s life. Campaigning for helping abducted children find their parents, I have been deeply concerned for the conditions of those kidnapped and sold girls, who may be controlled by the smugglers or hidden deep in the mountains. Otherwise they can find home themselves. So, every time I came across a mountain area, I would go into it and figure out whether any abducted girl was hidden there.

Brothers told us that there were over 150 families living in the village and more than 40 single men over 30 years old could not find wives. The number increased up if including those men in twenties who were of marriageable age. Situation was getting worse in these years. In the past it was rare that men of fifties were not married, that is to say, most of bachelors of today were born in seventies and eighties. So, there are three reasons of the forming of the bachelor village. One is that more and more women left the village and never came back again. The One-Child Policy and a cultural preference for sons has led to the elimination of millions of China’s girls, which in turn has created an influx of young men and an increased demand for brides. Moreover, due to the severe poverty, many villagers could not find wives. Even though the living conditions were greatly improved than 30 and 40 years ago, we still found a lot of unskilled and illiterate single men who were unable to find jobs to have wives.

Searching online, I found many other more well-known bachelor villages. In Xiang Xi, Shao Yang and Yong Zhou, these two places had severest situations. In fact, when our searching group went into the Da Bie Shan mountain areas, we noticed that many local single men could not find wives. At the beginning of this year, when rescuing the victim of the women smuggling, Deng Lurong, in Su Song County of Anhui Province, we discovered that Deng Lurong, a lightly brain paralysis amentia, was providing sexual services to dozens of single men in the town. She was given 20 yuan by each man. Because she was unable to bear, she always escaped to the mountain and lived in desperation like the-White-Haired Girl in the opera.

Visiting several villages along the way, we noticed that few young women were about in the villages, not mention those had good looking. On the contrary, groups of men drifted around doing nothing but smoking and chatting in the street.

Hunnan Province is not the poorest province in China. During the searching, I went to many poor and obscure mountain areas in Jiangxi Province, Guizhou Province, Anhui Province, Guangxi Province and Henan Province. I did not pay special attention on the phenomena of single villages because people in these places were still fighting against famine and had no time to think about their difficulties of getting married. The one-child policy brought a population imbalance. We thought that millions upon millions of men could not find wives in the next ten or twenty years. However I never suspected for a minute that the situation has been off hand now. In this less poverty-stricken village there have already been one-third families having unmarried single men who were unable to find wives. It is not hard to imagine the severity of prostitution, rape, women smuggling and many other necessary consequences. If things go on like this (the one-child policy is not abolished and the population imbalance is not improved), The phenomena of bachelor village will soon spread across the land and the whole society will be placed in chaos.

湘西光棍村探访记

一个较好的时机,和几个朋友来到湖南省土家族苗族自治州凤凰县,在电视剧《乌龙山剿匪记》里所描写的一个山村游玩后,走进了一个名叫下千潭的光棍村。

吴姓弟兄是这个村众多光棍中的一个家庭,也只有兄弟两人。我们进门时兄弟俩正在造房子,所有的建筑材料都是两人从山下背上来的,因为付不起工钱。房子也只好自己动手。哥哥告诉我们,现在住的房子是七十多年前祖辈建的,四面的墙也倒了不知多少次了,离房子不远的地方有一个大山洞,相传是当年土匪头子苗王的老巢,自从《乌龙山剿匪记》电视剧播出后,当地政府将其建成了旅游点。兄弟俩虽然家徒四壁,但却有一台二十多寸的电视,石头垒成的院墙上架了一个卫星转播天线,可以想象,他们在几乎没有任何收入的情况下,花上千块钱买这台电视机的真正目的,就是因为在这台电视机上有着他们全部的精神生活,打发着寂寞。

由于父母早逝,兄弟俩相相依为命的生活着,哥哥今年四十八岁,弟弟不愿说出自己的年龄,看上去也有四十三、四岁,问及两人没有结婚的原因,他们回答的很简单,就一个字:“穷”。因为就一亩地,种的粮食还不够吃,平日里靠帮村里各家打点零活挣些零花钱。哥哥没上过学,弟弟上了小学三年级,因为普通话说不好,又没一技之长,只能呆在村里。哥哥告诉我们,他已经不可能娶到老婆了,只能将希望寄托在弟弟身上,将省吃勤俭用积蓄了多年的钱建座房子,希望能为弟弟讨个老婆,现在的女人很实惠,如果弟弟有个新房子,也许会有哪个寡妇能看上会嫁过来,那样就了了自己的一生心愿,对的起去世的父母了。

弟弟很健壮,几天未刮的胡须间透出古桐色的脸,我们聊着聊着话题就转向了女人,与哥哥不同的是,弟弟不太喜欢呆在家里,没事和光棍们在一起谈女人,有钱时结伴下山去找小姐,镇子里小姐很多,弟弟告诉我:好一点的女人五十、一百打一炮,差点的二十、三十也有,光棍们也经常在一起交流信息,哪家的老公死了、哪家的女人离婚了、哪家从外面花了多少钱买了一个女人等等。

说实在的,对光棍们的生活我并不感兴趣,从事被拐儿童寻亲活动以来,特别是对近年来很多七、八岁乃至十多岁女孩被拐后的去向问题才是我所真正关心的,这样年龄的女孩如果不是被人控制了,如果不是控制在这些深山之中,是不难自己回家的。因此,每到一处山区,我总是想进来看看,有没有被拐的女孩子藏在这里。

兄弟俩告诉我们,全村大约150多户,仅三十岁以上找不到老婆的就有四十多人,不到三十岁的男人还不能算是光棍,如果加上二十多岁的适婚男子那就更多了。在他们之前没有这么严重的现象,村子里五十岁以上的人很少有人找不到老婆的,也就是说光棍们大多是上世纪七、八十年代出生的。所以说,形成光棍村的原因主要有三个。一是女孩子们走出去的多,一旦走出这个深山就不会再嫁回来的;二是山民们重男轻女传统观念非常严重,计划生育使得一些家庭为了留下指标生男孩,将刚出生女婴送人甚至弄死,导致了男女比例失调;第三个原因就是穷,虽说是因为穷才娶不上媳妇,可现在村民的生活比三、四十年前要好的多,走访中我们发现,留在村里的光棍大都是文盲或是无一技之长,因没有能力挣钱而无法娶到媳妇。

网上查了查,发现真正有名的光棍村还不是我所到的凤凰县,在湘西,最严重的地方是邵阳和永州等地。其实我在安徽大别山区寻亲时所到过的村庄也有很多的男人们娶不上媳妇,今年年初在解救安徽宿松县邓露荣被拐案中,有轻度智障的邓露荣就是为村里几十个光棍提供性服务,每人收二十元钱,邓因为忍受不了经常逃到山里过着现代白毛女式的生活。

沿途又走过了几个村子,发现年轻的女人很少,长相稍好点的年轻女人根本就看不到,相反,却有着一群又一群无所事事的男人蹲在村边路口抽烟闲聊。

湖南并不是中国最贫穷的省份,寻亲活动中我到过比这更穷的江西、贵州、安徽、广西、河南等偏僻的山区,只是没有留意光棍村这个现象,因为这些地方甚至连温饱都问题都没解决,娶媳妇是件连想都不敢想的的事。计划生育导致了中国人口出生性别大比例失调,原以为在十年二十年后才会有几千万人娶不到老婆,没想到现在的情况已经是如此的严重了。仅这个还不是特别贫困的村子里就有着三分之一的家庭里生活着娶不到媳妇的光棍,不难想象由此而产生的卖淫嫖娼、强奸、拐卖妇女等现象会有多么严重。如此下去,如果计划生育政策不能废除,男女出生性别比例再不缩小,用不了多久光棍村会由偏僻贫穷的山村向平原扩展,整个社会将处于一片混乱之中。

July 10, Shaanxi government have paid  70,000 yuan ($11,000) to Feng Janmei forced to have an abortion seven months into her pregnancy,  according to her attorney. The lawyer said the woman appreciated the financial compensation but said nothing would make up for the forced abortion and the taking of her baby’s life.

The forced abortion sparked international outrage as the picture of Feng Jianmei and the body of her aborted baby lying next to her in a hospital bed circulated the Internet.

 

The state-run Xinhua news agency said the money was meant to avoid any further legal entanglements over the abortion, adding, “The signing of the agreement means neither party should raise any question related to the issue again.”.

 

Zhang Kai, Beijing lawyer for the woman and her husband, Deng Jiyuan, said the couple agreed to the settlement of 70,000 yuan, but that the couple faces “spiritual pain” that will endure a lifetime.

怀孕7个多月的冯建梅惨遭引产案引发社会强烈谴责,陝西安康市政府称该事件属于“严重违规”,对镇坪县人口和计生局局长江能海,曾家镇镇长陈抨印和镇人口和计生办公室主任龙春来停职调查。中国妇权认为,一条鲜活的人命被强行毁灭,妇女的心身备受蹂躏,一家人的希望和爱被人为断送,安康市政府怎么能以 “违规”一词来掩盖下令者和执行者的犯行?怎么能以“停职”来代替涉案嫌犯 “立即逮捕归案”的法律程序?

陕西省人口计生委派员赴安康调查后称, 2001年《中华人民共和国人口与计划生育法》实施以来,该省人口和计生委明令禁止大月份引产。安康怀孕7月孕妇遭引产情况基本属实。此做法严重违反了国家和省人口计生委的有关政策规定,在社会上造成极为不良的影响。

中国妇权认为,既然“情况基本属实”,立即的法律制裁和民事赔偿就应同步展开,杀人就是杀人,人证物证俱全,该案已经查明“情况属实”,为何不立即采取相应的法律程序,拘禁隔离等,以免嫌疑人串供、销毁证据、或对受害人、检举人进行报复打击。强夺人命犯罪绝不是“违规”,这是两个截然不同的定义,陕西政府不应继续护短,并沿袭“大事化小、小事化了”的陋俗, 应当面对事实,严格执法,以彰显法律面前人人平等精神。

Reports by Women’s Rights in China volunteers indicate that after several days of domestic and international media and public pressure, Cao Ruyi, the pregnant woman who had been detained for five days by Hongshan District, Changsha Family Planning Commission, was allowed to return home. However, government threats to forcibly terminate her pregnancy remain.

 

Around 9 o’clock on June 10th, after performing an ultrasound exam on Cao Ruyi in the Hunan Province Women and Children’s Hospital, family planning officials planned to detain her at the Changsha County Women and Children’s Hospital. Despite heavy coercion, Cao resisted with determination. Family Planning officials brought her to one of three permanently rented rooms in the Beifu Hotel. They forced her to sign the Order to Terminate Pregnancy within Set Time, with the stipulation that she must have an abortion before October 16th. Past that date, she would be fined the “end of pregnancy collateral”. Cao signed the document in utter exhaustion. She returned home at noon accompanied by a cousin and a WRIC volunteer.

 

Cao Ruyi told the WRIC volunteer that the “collateral” was set by the Family Planning Commission at between 2,000 to 10,000 yuan. Because of her “bad attitude”, the fine for her was 10,000 yuan. If she did not pay the fine in time, the birth of the child would mean fines of over 100,000 yuan. Cao was determined to have the child.  Cao was unemployed. Her husband had to support the whole family including Cao’s mother-in-law. The financial situation of the family was difficult. Paying the fines would be impossible.

李甫告诉中国妇权义工,16号洪山街道计生办会来讨取保证金,如果按最低标准收取2000元,表示还可以接受,但按最高一万元来收取,不仅不合理,
他也没有能力支付,且交付2000元的保证金后,计生办应该补发准生证,否则一分钱都不交。李甫认为,妻子被强迫人流一事现在已经成为焦点,现在非常害怕
计生办报复,曹如意则特别担心孕期检查和将来临产的医院,都会无法正常进行。

中国妇权义工表示对曹如意的孕期到临产会一直关注下去,一旦遇有特殊情况会及时更换藏身地点,尽一切可能为曹如意顺利临盆提供帮助。

(中国妇权义工现场报道)连日来受到国内外强大的舆论压力,长沙市开福区洪山街道计生办放行控制长达五天的孕妇曹如意回家。但是强制流产的危险并未消除。

6月10日上午9时许,曹如意在湖南省妇幼保健院做完B超后,计生办准备继续将曹如意带往长沙县妇幼保健院,在对其进行所谓的思想工作后,曹如意坚
决不同意前往,无奈之下,计生办人员将其带到附近的北富酒店(计生办在此专门开了三个房间),逼迫曹如意在一份《限期终止妊娠通知书》上签字,要求其在
10月16日前终止妊娠,超过此期限,就要收取终止妊娠保证金,已经被折腾得极度疲惫的曹如意为了能回家得到休息调整,只得在此通知书上签字,中午12
点,曹如意在表妹和中国妇权义工的陪同下回到家中。

曹如意告诉中国妇权义工,洪山街道计生办人员表示,保证金按规定是2000至10000元人民币,介于她的表现情况,要按最
高限度的10000元收取,如果不按期交纳,且生下孩子后,将会面临十几万元的罚款,曹如意表示,孩子肯定要生下来,丈夫打工,自己没有工作,家中还有婆
婆要赡养,一家人生活都很限难,也交不出那么多罚款,计生办人员威胁说届时会没收她婆家房屋拆迁款来抵押计生罚款。

闻讯赶回家的曹如意丈夫李甫表示,感谢社会各界对他们的关心,特别请中国妇权向美国议会的史密斯先生表示衷心的感谢,如果没有社会舆论的关心,妻子腹中的孩子肯定保不住,关于罚款一事,由于家境贫穷,无力交付,希望通过法律程序讨回公道。

Women’s Rights in China Successfully Organized Conference on Family Planning Policy and Population Development
Family Planning has been the national policy of China for more than 30 years. What are the reasons for this policy? What are its effects on Chinese society? Should the policy continue to be implemented? On May 29th, 2012, Women’s Rights in China held the Conference on Family Planning Policy and Population Development in New York, USA. WRIC invited experts and scholars to discuss the Family Planning Policy’s impact on society, family and individuals in China and problems currently facing population development in China.
A group of scholars participated in a morning round table discussion session, including Tibetan history researcher, woman’s writer Li Jianglin, theorist Hu Ping, WRIC founder Zhang Jing and One Child Policy victim Han Wu. A BBC interview of Ma Jian, author of Yi Zhi Dao, was also broadcast. In the afternoon, Ma Jian, Ann Noonan, Zhang Yujun gave talks. Chinese population policy experts Yang Zhizhu and He Yafu, both of whom were unable to attend, submitted papers that were read by others. More than 120 New York residents attended the event, including Wang Xuezhen, who shared her experience of 11 attempts at meeting Chen Guangcheng during his house arrest.
Professor Yang Zhizhu, formerly Associate Professor of Law at Chinese Youth Political Institute, was fired in 2010 for having an extra-quota child. The birth of his second daughter and its aftermath initiated fierce debate in Chinese society. The event catalyzed the most closely watched public debate the One Child Policy’s thirty year history. Prof. Yang had long commented on China’s Population and Family Control policies. His articles have appeared in Chinese publications such as Southern Weekly, New Kuabao, Eastern Morning Daily, New Beijing, Modern Express, etc. He was a leading activist and dissident against the One Child Policy.
Professor Yang’s report, The Situation of Chinese Women Under The Birth Control Policy, stated, “From fear of persecution of the One Child Policy and forced abortions, many women had no choice but to hide or leave their homes. Ultimately these women gave birth taking considerable risks outside of registered hospitals. This situation resulted in the death rate from birth among mobile population to exceed pregnant women in rural areas. Women giving extra-quota births, which accounted for 6% of the total population of pregnant women, accounted for 50% of deaths.”
He Yafu was a former reporter for Coastal News, founder of Babi Translation Agency. Mr. He had published hundreds of articles on Population and Family Planning Policy on the internet. The web visitor count of his microblog had reached over ten million, leading all other microblogs focusing on the One Child Policy. He also published articles in Eastern Morning Daily, First Financial Daily and China Youth Daily, etc. Mr. He was an accomplished commentator on Population Development and Family Planning Policy in China.
Mr. He’s paper, Why The One Child Policy Should Be Abolished, stated that “Over population in China” was a myth. Of the more than 200 countries worldwide, almost none practiced forced birth control outside of Mainland China. Whether a country was overpopulated depended not on the total number of people, but more importantly its population density. Many countries had higher population density than China, for example, South Korea at 487 persons per square kilometer and Japan at 337. In contrast, China’s population density was at 140 persons per square kilometer. Even taking out inhospitable parts of western China, its population density would still be far below Japan and South Korea. Governments in Japan and South Korea not only did not practice the Family Control Policy but actively encourage reproduction.
Mr. He pointed out that to enforce draconian population control policies would require sufficient rationale. Forced reproductive restrictions infringed upon the basic human rights of citizens. He proposed a test of three criteria: One, would fewer population lead to quicker prosperity? Two, was the Family Planning Policy the only vehicle to control population growth? Three, human rights. The Family Planning Policy could not pass even the first, practical test let alone the latter two. There were no solid reasons to enforce it.
Ms. Ann Noonan was the director of the Committee for U.S. International Broadcasting. Ms, Noonan said that reproduction was a basic human right. The One Child Policy was a severe abuse of human rights. It was one of the most egregious and violent persecutions of women in the world today. Ms. Noonan said that women and their families in China who are victims of human rights abuses need Voice of America (VOA) radio and Radio Free Asia (RFA) broadcasts. She reminded victims of the policy that the American people would not sit idle while millions of innocent victims shed their blood.
WRIC member Zhang Yujun gave a presentation of reports on a widespread yet largely unpublicized child brides in Putian, Fujian. WRIC volunteer Yao Cheng had been investigating and reuniting child brides with their families since 2009.
Mr. Ma Jian gave the last presentation. Ma Jian was a famous Sino-British writer whose novel Beijing Coma received the 2009 British International Free Speech Award, 2009 Athens Literature Award and nominated for Berlin Literature Award. Beijing Coma has been published in more than 30 languages around the world. Mr. Ma was listed as one of fifty most important modern writers by French magazine Lire in 2004. Mr. Ma’s newest work, Yin Zhi Dao was the result of seven years’ labor. It combined large numbers of in-the-field interviews and countless factual cases to tell the complete story of the One Child Policy.
Mr. Ma emphasized that one book could not stop the One Child Policy. However, it was the duty of a writer to express respect for life, especially the life of a child who had yet to taste a breath of air. The Chinese government regularly executed millions of innocent babies in the womb every year. The warmth body of a loving mother became all too frequently the execution ground for babies. Since 2008, Family Planning Policy passed from the responsibility of the propaganda departments to “secret agencies” headed by Party Committee chairmen at all levels, whose actions were hidden from reporters, making Mr. Ma’s investigation much more difficult.
 Family Planning Policy, Mr. Ma said, was the result of a planned economy. Since the planned economy had already been abolished in China, the Family Planning Policy should be as well.

Women’s Right in China held in Flushing, New York Office “China’s Family Planning Policy and Population Conference” on May 29, 2012. Participants of the conference had very heated discussion on China’s forced family planning policy and its impact on Chinese society.

The first speaker was the Tibetan history expert and writer, Li Jiangli. She made public the first time her horrible experience of forced abortion. She said, abortion brings more pain than any other physical pains to a woman because not only she has no dignity when the abortion is in process but also she feels like a conspirator killing her child. Women can gather together and talk about anything – but not about abortion because the process is too painful. Li Jiang stated, abortion is the commonly shared nightmare, scar, and secret of all the women in China. On the other hand, a woman will never share the experience with her husband or male partner, because he cannot truly understand the pain of his woman. Men are excluded from the issue of abortion and it is likely they don’t want to learn about the experience. Being unable to protect his woman makes the gap between two sexes

Theorist Hu Ping also explained his point of view that China’s forced family planning policy is an unprecedented violence. What is more perplexing is that the policy is enforced without much resistance – even the privileged class is included. From official statistics, there are annually 10,000,000 abortion cases in China, which is like massacre of 10,000,000 people. One-Child Policy incurred millions of families without decedents, because they have only one child and later loose them when parents loose reproduction ability. One-Child Policy also results in the fact that the only child is harder to educate. In order to advertise the family planning policy, the China Communist Party fervently advocates for eugenics, which is closely interconnected with Fascism. Besides, the family planning policy consolidates discrimination against peasants in China. In fact, there has never been any societal discrimination against peasants before the China Communist Party established in recent 60 years.

Han Wu asserted that men are indirect victims of the family planning policy as well. After his wife was sterilized, he felt like their intimate life was unlocked by the sterilization ring. All the participants concluded that both men and women are victims of forced family planning policy.

When discussing why the forced family planning policy is so entrenched, initiator of Women’s Right in China, Zhang Jing used a couple of figures to demonstrate the issue. Zhang Jing said, according to official statistics from Chinese government in 2005, there were 58,700,000 family planning officials, 1,142,000 full-time family planning officials, and 57,270,000 part-time family planning officials. This means there are more than 100,000,000 people, which are one tenth of the whole population of China, involved in enforcing family planning policy. What is more, there are about 40,000 community family planning offices and about 5, 000 family planning service stations. The State Council has more than 20 departments dedicated for family planning policy – no such governmental policies would be this prevalent! Averagely, every Chinese citizen annually pays ten yuan for the family planning policy.

Aside from the shocking benefit chain, the family planning policy even practices “political veto,” thus further consolidating the link between the family planning policy and the political life of governmental officials.

When discussing how to change the family planning policy, Li Jianglin asserted that women should no longer remain silent, and speak out their pain from abortion; otherwise, this pain will go on to their daughters, daughters-in-law, and granddaughters, etc.At the end of the conference, an interview from BBC with Ma Jian, a traveling author in Britain, was played. Ma Jian stated his new book Dark Road was a persecution of China’s family planning policy, and was also an attempt to regain women’s control over their uterus.

自4月22日反一胎化維權人士陳光誠逃出監控後,中國地方政府加強了對違反一胎化政策的“超生”家庭及孕婦採取更為嚴厲的措施,前中国国家人口和计划生育委员会主任、現安徽省省长李斌所管轄的安徽省行動最為神速。宿松县计生办從4月28 日起开始派出大批工作人员,在全县范围内对非盈利組織中国妇权幫助的超過400個女婴家庭和孕妇进行查访,其中數十个“计划外”生育的女婴家庭和怀孕的妇女将面临严重罚款和惨无人道的强行性堕胎。

《中国农村女婴辅助计划》针对中国大陆男女性别比例严重失调而开展的一项公益活动,旨在摒弃传统重男轻女政策、提高广大农民家庭保护女孩意识,仅在宿松县就好几百个家庭受益,该计划自始至终没有附加任何条件,获得广大农民朋友的一致好评。然而宿松县计生办人员高调的查访行动,使受助的农民家庭人心惶惶,计生人员扬言:所有“计划外生育”的家庭将面临五万多元人民币的罚款,“计划外”怀孕妇女的也将面临强制堕胎,这意味着数十条生命将被屠杀。

计生人员还威胁我们的义工说,她若不合作将会遭到强行辞退,也就是说,不交出女婴辅助计划的各种登记资料,不配合他们的猎杀行动,她将失去赖以生存的工职。

中国计生政策实行三十多年来,亿万无辜的生命被屠杀,人口老化、性别比例严重失调等社会问题已经显现,但政府置若罔闻,不人道的强制计生政策臭名昭著。宿松计生办将农村女婴辅助计划这样利国利民的慈善活动,上升到政治和法律层面,并对怀孕妇女进行强制流产以及女婴家庭进行非人道的处罚,只会激起广大农民朋友和所有珍惜生命者对中国政府的更大反感和加深其政府人员的罪孽。

中国妇权强烈警告宿松计生办,立即停止干涉这项慈善活动,停止对受助家庭和志愿者非人道的处罚和威胁,将政府“和谐社会、以人为本”体现出来,而不只是一句虚假口号;吁请计生工作人员,重良知讲人道,做上对得起祖宗,下对得起后代事情,停止助纣为虐,回头是岸。

中国妇权声明,如果宿松计生办一意孤行而对孕妇强行堕胎、对受助的女婴家庭进行强行罚款,并解雇有关义工的全职工作,我们将通过媒体的道德谴责和诉诸于法律程序,予以讨回公道。

I Historical Overview
1) Events relating to gender equality in the two decades following the first Chinese Constitution in1954:
1. Promotion of schooling and access to education for girls.
2. Mobilisation of women to join the labour force. At the time, the means and conditions for women to get paid employment were as follows:
a. Implementation of an employment plan,
b. Reaffirmation of women’s right to take part in the collective paid work of production
units in rural communities.
3. Broadening of the range of decision making positions in society accessible to women.
4. Improvement in women’s contribution to and social recognition in society.
5. Establishment and development of feminist associations.The Chinese Women’s Association was set up in 1949 and built a 5-tier network (for the purposes of
administrative authority Translator’s note) extending from Government to urban quarters and rural villages. Committees and divisions of the Chinese Women’s Association were also set up in the mining industry and in specialised units for teaching and research.
2) Following this period, China went through thirty years of gradual reform and economic
opening. The economy took off and living conditions improved.
During this period the domestic market remained vibrant, household consumption continued to grow.
1. As China entered the 21 stcentury the state of social development in Chinese society
underwent several upheavals that had a complex impact on the way equality between
the sexes evolved.
2. After thirty years of reforms and opening up, the Chinese economy and its social
structures were subjected to massive change while clearly making progress. Chinese
women took an active role in this change and benefited from the situation.
3. After emerging from the era of a planned economy China is inexorably moving
towards becoming a globalised market economy. This, for Chinese women has both
positive and negative implications
i. Thanks to rapid economic growth, women have ever improving employment prospects
with higher earnings potential. Women with sought-after high level skills and
training can use these abilities in a context that encourages efficiency and
competition.
ii. Because of changes in society, the traditional systems that offered some guarantee ofprotection of women’s rights and interests have been challenged by the
market economy, and are no longer applicable.
4. The 4th World Conference on Women held in Beijing in 1995 was an unprecedented
opportunity for Chinese women to make their voices heard in the tumult of social
change and reform going on at the time:
i. At this 4th UN World Conference on Women, the Chinese Government declared “our
goal is to place gender equality at the heart of the promotion of social
development in China”.
ii. Holding this conference in Beijing provided a new window of opportunity for the
Chinese public to become more familiar with the idea of gender equality and
increasing involvement of women.
iii. In August 1995, China launched a new government action plan for promoting gender
equality and improving living conditions for women: ‘The life improvement plan for Chinese women 1995/2000’ hereafter referred to as the ‘1995 plan’. Another one was launched in 2001: ‘the life improvement plan for Chinese women 2001/2010’ referred to later as the ‘2001 plan’
iv. A decade after the conference , an amendment to the PRC’s legislation relating to the
guarantee on women’s rights is adopted.
II   Important points relating to the current position of women.
1. It is imperative that peasant women lift themselves out of poverty
1.1 Peasant women still live in poverty today.
1.2 Inequality still clearly exists judging by the largely female rural workforce.
1.3 Peasant women are usually left behind in the migration process to urban areas.
1.4 The three elements these women need most: finance, technical wherewithal, a means to earn a better living.
1.5 Peasant women need confidence in their future.
2. Employment and reorientation of women in towns and cities.
2.1 The negative impact of deeper labour reform and regulation of economic structures
became increasingly apparent after 1995.
2.2 Academia in China has traditionally viewed women as being a marginal work force in its employment theories.
2.3 The employment situation of women in China clearly reflects marginalisation.
3. It is essential that the women take a greater role in the political and social decision-making process. Even though Chinese women are increasingly becoming involved in politics, a great deal remains to be done and the current situation is not optimistic.
3.1 Whereas the percentage of women in national assemblies around the globe is on the rise, in China female representation to the people’s assembly is dropping in national assembly and international organisation rankings. Domestically, female representation in village committees hasbeen poor since 2000, the year when records began, with scores hitting a low in 2004 with only 15% participation from women.
3.2 A fact that should not be overlooked is that women who hold decision-making positions are more often than not deputies or working in divisions that are unrelated to the economy. As aresult they are sidelined from power.
3.3 In 2008, China underwent various changes in government, presenting a new challenge towomen’s participation in politics.
4. Women and consumer rights
4.1 Women are increasingly becoming targets for marketing campaigns and there are still problems in the field of the protection of women’s consumer rights and interests.
4.2 It is necessary to pay particular attention to women’s rights as consumers, so that they can consume safely. Women should be encouraged and taught how to be more discerning, healthy and reasonable consumers. At the same time, the consumption environment needs to be improved as well. Attempts to reduce the female body to being a vulgar consumer product should be strongly discouraged.
4.3 Women-oriented consumer surveys and the creation of a female consumer forum would encourage companies to be more socially responsible as well as provide guidelines on women’s consumption.
III  Difficult to resolve issues
1. Promotion of society that respects equality between men and women through legislative and policy leadership. According to the spirit of the constitution, sexual discrimination is never intended in the establishment and implementation of laws. Nevertheless, sexual discrimination is common both in the drawing up and
implementation of supposedly gender-neutral measures, due to lack of awareness of the principle of gender equality. Measures relating to gender equality and equal rights
face many obstacles from an objective point of view. These are the main problems China faces in establishing a system that respects gender equality. Amending or repealing social policies that go against the principle of gender equality, taking
decisive measures to put an end to the above mentioned issues – in other words transforming discriminatory measure into egalitarian ones – are just some of the ways in which China could build a national policy for gender equality. At the same time it should provide a response to the urgent problems relating to equality between the sexes – a response that any society claiming to protect gender equality must provide.
2. Emphasising the importance of training and education in order to raise the general level of education in women. The difference in status between men and women compounded by old traditions means that access to education is generally more difficult for women. Less educated women face a higher risk of being marginalised in the increasingly competitive climate in China resulting from its adhesion to the WTO.In addition to this many women deliberately pass up opportunities to get technical training because of lack of understanding of the advantages such training could bring or because they are too burdened by responsibilities in the home. Most women cruelly lack knowledge and experience in how to set up and run a small company.In a system that is based on a market economy, making profits is of primary concern. As a result, women’s lack of education can seriously damage their chances of getting a job in a highly
competitive labour environment.
3. Setting up financial systems that favour entrepreneurship in women. Women suffer from insecurity in the job market because of sexual discrimination. Women’s associations play an important role in the promotion and support of female enterprise. The main obstacle faced by women today in finding a job or setting up a small business is obtaining financial backing. Microcredit programs don’t take sexual inequality sufficiently into account and tend to lack in flexibility as a result. Loans are generally requested and granted to household units. Since men are usually considered to be the head of a household, they are naturally given the right to request such loans, depriving women of the support to which they should be entitled.
4. Protecting human and health rights. Threats to the right to life and women’s right to health should be recognised, against a background of an imbalance in the ratio of girl/boy births (more boys than girls). Firm measures must be taken to guarantee the health of newborn and young girls in order to give them the same chances as boys with regards to proper nutrition and health care. Furthermore, attention needs to be paid to the issue of elderly women who are ill or living below the poverty line in towns and villages. Society should offer help to elderly women who do not have health insurance or a pension. It is also important to be aware of the ravages caused by domestic violence. The complexity of the issues involved should be apprehended in order to guarantee proper protection of women’s rights in the home and in their private lives. Preventive measures should therefore be taken to put an end to violence against women and sexual harassment. Gender should be taken into account when analysing data relating to trends in the spread and means of transmission of sexually transmitted diseases (STD) – especially AIDS. It is vital to produce gender-based statistics and data in order to ensure sexual equality in STD prevention measures, given that women are more affected than men. Equality between the sexes is a principal that should be taught from as young an age as possible, in order to instil the younger generation with the idea of sexual equality and mutual respect. 陕西镇坪县冯建梅怀孕7个多月被强迫引产事件,当地政府的调查结果和处理决定引起全国各地民众的不满,网民更是同声指责,政府之前所承诺的一切并没有兑现,冯建梅丈夫邓吉元还被殴打并被迫逃亡, 6月28日邓到达北京找到律师,7月1日陕西地方官员紧追到北京律师处,要求其交出邓吉元。

6月22日一德国记者和一义工两人相伴来到山西安康镇坪,原以为镇坪政府道歉是开明、罕见的做法,打算去采访并做正面报道,谁料镇坪政府看见竟有白人“入侵”,如临大敌,严阵以待,派人团团围住,不准仍在医院的冯建梅开口说话,白人记者欲采访邓元吉,也眼巴巴被人拦住,不仅没有采访到,之后,还被当地人员威胁、驱赶, 吓得2人开着车就跑,但追车紧盯,一直追到一百多公里以外才罢休,整个过程就是“蝙蝠侠”探访陈光诚的翻版。

冯建梅的丈夫邓吉元,在德国记者来到镇坪后,镇坪县曾家鎮街头贴出了大标语,不仅直接指邓是“卖国贼”,还要“痛打”他,一群人还打着横幅游行,要将邓家“驱出曾家鎮”。邓吉元欲外出求助,遭拦截被人殴打。镇政府有关机构冷眼旁观整个过程,没有出面阻止。

邓吉元走投无路,想起日前从北京专程到镇坪来帮助冯建梅家打官司的、但被邓婉言谢绝的张凯律师,6月24日邓吉元摆脱跟踪开始了他的逃亡生涯。

邓吉元说:“24日我跟村领导一起去吃晚饭,或许是因为村领导答应了政府看住我,或许是因为我两天前挨了打,也或许是因为我连换洗衣服都没带,他们大概以 为我逃跑的可能性不大,只派了个女人在后面跟踪。但是吃过饭回医院的路上,村领导被县领导电话叫走了,叫我自己回医院,于是我让摩的司机开快点,想摆脱后 面那个跟踪的女人。因为车没人家的好,兜了几圈也没摆脱掉。于是我付了钱从公路往下跑到河床边,沿着河床跑,那女人跑不过我,一会儿我就摆脱了追踪”。

邓吉元还说:“那条线路查得很严,安康、西安方向也不松,路上有许多关卡。我先在镇坪一个朋友家躲了两天,连手机卡和手机电池都卸载了,不敢睡觉,更不敢上街买换洗衣服,怕被他们发现抓走。然后,我在26日傍晚包了一辆车往安康方向的车,每到关卡附近就下来,沿着河床走,绕过关卡再上车,花了七八个小时才到平利县的广佛镇。我想,到安康、西安坐车肯定有政府的人拦截,因此我在广佛休息了几个小时之后,包了一辆车,经过十多个小时到了湖北十堰,坐上了开往北京的火车。今天一早就到了北京。”

邓吉元经历了5天83个多小时的逃亡,终于来到了北京,找到了张凯律师的家。28日邓吉元在中国妇权义工及个别媒体的见证下,与张凯律师签订了合约,正式聘请张凯代理他们与当地政府就强制引产案诉诸法庭。

藏人不惜自焚以表达抗议。2012年一开年的14天内已有4名藏人自焚,以牺牲年轻的生命来唤起人们的关注。谨此,我们向英勇抗争的藏族姐妹兄弟表达我们崇高的敬意,向死伤者及其他们的家属表示诚挚的慰问。

中国妇权认为,中共长期以来妖魔化藏人精神领袖达赖喇嘛、在西藏开展
“送国旗、送中共领袖像进村入户进寺庙”的“九有”活动,是肆无忌惮的扭曲、丑化、毁灭藏人传统文化和宗教信仰,强迫少数民族接受共党文化的野蛮行径,尤
其是中共调派大批军警,开枪射杀射伤藏人,逼迫信奉和平的僧尼绝望中以自焚抗议,与当今潮流背道而驰,为中国文明发展蒙羞,为世界民主国家不耻。我们对这
种反人类的种族、文化灭绝政策表示强烈抗议。

我们认为,藏人精神领袖达赖喇嘛倡导的中间路线,不追求独立,愿意在中华人民共和国宪法框架下实现藏族地区真正的高度自治,是解决民族问题的最佳方案,但是我们至今看不到中共解决民族问题的任何诚意,这导致了民族问题在藏域以及其他广阔的少数民族地区更进一步恶化。

当前,中国老百姓和中共权贵的矛盾空前激化,抗暴维权风起云涌,中共专制集团已经成为汉族、藏族和各少数民族的共同反抗焦点,2011年中国大陆爆发18万件的群体事件,绝大部分发生在汉人地区,说明各族人民抗暴是共同选项。

我们强烈要求中共当局因应世界潮流,善待各族人民,停止执行强硬镇压的野蛮政策,采取真诚与藏人精神领袖达赖喇嘛或藏人流亡政府对话协商,以解决藏民族问题。

中国妇权关注包括藏族姐妹在内的所有同胞姐妹,关注在独裁政权下遭遇不公和苦难的所有妇女儿童,我们呼吁各族姐妹保重身体,珍惜生命,留得青山在,笑看残雪融,希望的曙光即将破晓!

(中国妇权网记者万全、张菁报道)2012年1月14日傍晚,中华民国第十三任总统选举结果揭晓,现任总统马英九战胜了民进党的蔡英文和亲民党的宋
楚瑜,获得连任。马英九及搭档吴敦义获得689万1139票,得票率为51.6%;民进党蔡英文及搭档苏嘉全获得609万3578票,得票率为
45.6%;亲民党宋楚瑜及搭档林瑞雄获得36万9588票,得票率为2.8%。由三位留洋博士共同角逐总统大位的本次选举,开创了华人历史先河。这三位
博士是:哈佛大学法学博士马英九,伦敦政治经济学院法学博士蔡英文,华盛顿乔治城大学政治学博士宋楚瑜。由于本次选举是总统和立委同时进行,即并选,台湾
各地设置了近1万5千个投开票所,工作人员近20万人,选举的总投票率为74.38%。

选前有人分析,国民党如果败选,将意味着这家百年老店的终结,中国国民党将会一分为二,以王金平为首的本土派将统领台湾国民党,国民党将彻底蜕化为
一个台湾政党,和民进党人一起携手在这个为四洋环绕的宝岛上安身立命。另一派抱着民国大梦的国民党人将被虚化,他们或寿终正寝,或飘零海外,或回归大陆。

选前之夜,一位大陆老兵扛着写有
“挺马保卫中华民国”的标语牌,孤独一人走在夜幕下的凯达格兰大道上。其实,每一次国民党人和民进党人竞逐总统宝座,都会被一些残留有大中华情结的台湾人
视为“中华民国”保卫战,选战的每一环节都会牵动他们身体里流淌千年的中华血脉,在谈及中华命运时他们经常泪流满面。

那边厢,蔡英文败北,但得票总数超过2008年大选100万票,这次立委选举绿营再拿下40席,比上届多13席,事实上蓝营也输掉了十多席,而马英
九比起4年前却输掉了近100万张选票,小英女性领军人可谓虽败犹荣,在民进党经历阿扁贪污丑闻几年的缠斗后,依然有这样的好成果,小英不但功不可没,更
以领军有方著称。

大选揭晓当晚,一连晴了好几天的台北,忽然大雨涟涟,如挺绿的609万百姓的眼泪。蔡英文站在台上宣布输掉了总统选举,她不吭不卑地说,我们输掉的
主要原因是我们没有向选民说清楚,没有做好竞选宣传和布局,民进党稍后会提出详细的检讨报告,会有一个警惕。祝贺马英九先生当选中华民国总统,希望他更好
的带领台湾人民向前走。民进党曾经输过,但我们从不放弃。她说:虽然我不能带领大家继续走下去,蔡英文也要以个人的身份,感谢大家一路相伴。台湾不能没有
反对的声音,不能没有制衡的力量,未来的4年,虽然我们没有办法以执政者的角度来实践我们的理想,但这并不代表就再也没有力量,我相信只要大家站在我们背
后,给我们支持、鞭策,我们一定有未来,下一次,我们一定会赢。败选的责任,我会一肩扛起,我宣布,将辞去民进党主席职务。台下年轻人泪水和老天的雨水浑
成一片汪洋,悲哉壮哉!

台湾2012年总统大选,赢的理直气壮,输的堂堂正正,没有过往的喊冤叫骂,没有选前节外生枝,台湾民主日臻成熟,世界有目共睹!

二、大选回放:

台湾民调 选前沉寂

晚上11点半飞抵台北桃园国际机场,因行李颇多,且所住酒店远在城市北端,坐国光巴士去市区颇费周折,索性打的前往。的士司机是个三十岁左右的瘦男子,操一口闽南味的国语,很热情。

这日已经没有大选民调的发布,2006年台湾颁布的选罢法规定,投票日前十天开始任何机构不得发布民调结果。

计程车在黑夜中高速行驶,笔者问司机,这次投票准备投给谁?他毫不犹豫地回答:“宋楚瑜”。问其原因,说是同情弱者的心态使然,不用说他已断定在这场三方角逐的游戏中,宋楚瑜是弱小受气的一方。

第二天出门,在公车上遇见一位文静男青年,刚大学毕业,正等着服兵役,他一路指导我们转换捷运,生怕我们弄错了线路。在地铁车厢里,我问他会投谁的票,他说“马英九”。

从自由广场回来时,打了一辆计程车,上车后继续做民调,司机的回答是“我选蔡英文”,因为“马英九这四年做的不好,换上蔡英文试试,如果她也不行,四年后再选掉她。”

回到酒店,和台南一位出家人联系,问他是否投票,回答是会投宋楚瑜,因为他已经厌倦了蓝绿,换个颜色看看。

几天下来,我随机调查了五名台北人,蔡英文2票,宋楚瑜2票,马英九1票,得票率20%。这是纯个人行为,笔者明白结果当属盲人摸象,不知失当放大
了哪个部位,使台湾的政治生态如此严重变形,没有哪一家想混下去的民调机构敢于发布这样的结果,尤其是在国民党大本营的台北。

13日上午,去到位于台北市中心的宋楚瑜竞选总部,曾在李登辉时代担任过蒙藏委员会委员长的亲民党海外部主任张骏逸说,外界预测宋楚瑜可获100万
选票,这在2300万人口的台湾,真是区区小数,绝对不可能和我随机问得的40%的比率匹配。张骏逸把在投票日前十天不得发布民调一事归咎于马英九在
2000年的行为,他称,当时宋楚瑜选情很好,不料就在投票前夕,马英九公布了一项对宋楚瑜十分不利的民调结果,第二天选民们转投他人,葬送了宋楚瑜的总
统梦。当然张骏逸的说法当即遭到陪同我们前往的原新党立委反驳,指宋当年落选,完全在于李登辉利用兴票案对他的打压。

关于如何获取台湾民意,笔者在台中的中华大学听取了民调研究专家归纳的四种方法:

1)机构民调:其结果广为人知。

2)台湾未来事件交易所:把候选人当期货,前些年很准,但现在为外力干预,已经离谱。

3)地方赌盘:土洋结合的产物,将现代政治结合到黑色交易中,有人怀疑2004年的两颗子弹与之有关。

4)官方调查站:从各地汇总民国调查局,交执政当局参考。据说准确性很高,但不予公布。

一些台湾人相信美国人的出口民调的准确性,2004年一名美国人曾站在投票口外询问投完票的选民,得出陈水扁不可能胜选的结论,但结果正相反,更有人相信,2004年大选,两颗子弹只是障眼法,真实原因是点票舞弊。

但中华大学专家修正说:出口民调在别的国家可能行,但放在台湾绝对不行。因为台湾的选民不易说真话,其中原因有黑帮操纵或金钱收买,被人控制的选民当然不愿意说出自己真实的选择。

三、林浊水两岸关系三段论

“台独理论家”林浊水是民进党内至尊级的人物,自认在党内的辈份与陈水扁一拨,属第二代。2008年三月,马英九大胜谢长廷,连受重创的民进党哀声
一片。那时,笔者在中华民国立法院旁的一间办公室内与他约定专访,在这位阿拉伯语系毕业的民进党人身上,见着的不是战败者的颓唐之气,而是睿哲的清新。他
谈起了民进党人对台湾政治变革的推动,论及冲撞风格为台湾争得主权,如今面临台湾建国之艰难工程,需要的不再是冲撞,而是精细的工作。

2012年大选,已经连续五次担任台湾立法委员的他,又在新北市新庄出马竞选第八届立法委员。在本次选举中,第三代民进党领袖、总统候选人蔡英文以
“台湾共识”
冲击马英九的“九二共识”,林浊水没有否认“台湾共识”意在推动台湾建国进程,但认为其效果如何有待日后检验。林浊水是民进党两岸政策的重要制定者,他在
选举前夕表示无论台湾大选结局如何,两岸关系都不会有重大转变,因为“两岸各自分立的现实,和台湾独立难以获得国际承认”这两个框架局限,“逼使共产党、
国民党和民进党三党在处理台湾问题上走向务实方向”。

投票日临近,我们来到林浊水设于新北市新庄的竞选办公室里,忙于拜票的他抽空招呼我们这帮远客,话题自然聚焦在大选及两岸关系上。林浊水把1949
年以来困绕的两岸关系的难题概括为“各自分立,对主权又各有不同主张。”他把60多年的两岸关系划分为三个阶段,并认为从趋势上看,无论政治家们在表面上
吵得多厉害,都无法掩盖走向缓和的事实。

林浊水说:“早期的解决方式是武力解决。北京说要武力解放台湾,蒋介石宣称的反攻大陆也是武力解决。到了蒋经国和邓小平的时代,大方向已经转变为和平解决。台湾说要三民主义统一中国,大陆方面说要一国两制,和平统一。”

这两个阶段的转变不仅发生在执政的国共两党,也发生在新生的民进党,尽管在戒严时期,早期的台湾民主运动无法清晰地表达他们的主权主张,但根据与党
外运动高层有联系的台湾海外同乡会回忆,他们的主流也是主张武装革命的。而在美丽岛事件之后,海外主张武力的人才逐渐回到台湾从事和平民主运动。

林浊水认为无论是共产党、国民党或民进党,在前两个阶段几乎是以同样的步调在发展。

两岸关系的第三个阶段开始于1990年代,特点是主权问题逐渐被经贸问题掩盖,但北京并没有放松对台湾独立的防范。林浊水说就在这个阶段,北京出台
了被国民党和民进党普遍认为是大陆武力犯台法源的《反国家分裂法》,但他不这么看,因为发动战争不需要法源。令林浊水感到意外的是,《反分裂法》规定,在
三种条件下,大陆会采取非和平手段对付台湾独立,他认为这与大陆的宪法相冲突,因为中国宪法不可能允许对主权独立问题讨价还价。那北京为什么要违宪制定有
附加条件的《反分裂法》,林浊水分析是为了向台湾传达一个重要的信息:现阶段把武力废而不用,把统一问题搁置到未来,把现阶段两岸关系的主轴放在经贸关系
上。

林浊水认为此次大选大陆成功做到了以商促统、以商为政,经贸的统战效应充分得以体现。因为选前,台湾著名实业家纷纷表态支持九二共识。与北京同步的
是,国民党的“不统不独不武”政策也是搁置主权,大力推进两岸经贸关系。民进党也在不放弃建国努力的基础上,改激进方式为和平务实,蔡英文甚至表示可以概
括承受马英九与大陆签订的ECFA。
林浊水说:“两岸关系的三大阶段,每一阶段都延续一二十年或三十年,这说明趋势如此,我觉得要推翻两岸各自分立的现实不易,本土人士想急切追求独立并获
得国际承认也不易,这两个条件的框架局限,逼使共产党、国民党和民进党三党逐渐走向务实方向处理台湾问题,因此我认为无论此次台湾大选的结果如何,两岸关
系不会有很大变化。”

台湾民意也似乎印证了林浊水的说法,12月份的一次民调询问如果蔡英文当选,两岸关系是否会倒退?结果只有少数人回答会倒退。

四、李远哲率200学者挺小英

逢绿便挺的1986年度诺贝尔化学奖获得者李远哲12日晚上在台中市为民进党总统候选人蔡英文站台造势。曾做过12年中华民国中央研究院院长的李远
哲在晚上8点多携夫人登场,成为整个造势晚会最高重量级的人物,他在全场的欢呼声中用台语讲话,令笔者听得云里雾里,只听明白了一句用国语说出的“人类面
临极大的困境”,接下来又是台语,大概是蔡英文是能带领台湾人走出困境的人。

台中历来是国民党的天下,曾做过中华民国外交部长的东北人胡志强盘踞市长大位已超十年。不过近年来,民进党势力也逐渐掺入,2010年五都选举,民
进党在台中的战绩就令国民党吓了一身的冷汗。为攻克这座蓝营的堡垒,绿营大佬苏贞昌、游锡堃纷纷出场,陪李远哲出场的还有数百位学者教授和医生,大名鼎鼎
的狮友后援会、扶轮之友后援会等悉数登场。台湾名歌手余天还为民进党选民制作了如何投票的录像片,教导人们不要在投票时犯错。

特工警察及民进党纠察队员从五万名现场支持者组成的人海中劈出一条通道,蔡英文在9点半从此登上大舞台,与其副手苏嘉全及再次登台的李远哲夫妇手拉
着手,把全场的热情鼓动上了最高潮。蔡英文许诺如果当选,就要把台湾国会搬来台中,令其成为台湾的次首都,她称台中历来都是最重要的选区,只要台中赢,全
台都会赢。“上次五都选举我们只差一点点,这次让我们一起冲过去,好不好?”

“好不好”是蔡英文演讲中常用的口头禅,接下来是全场的“好”声及呼喊。就是在这样的呼应中,蔡英文说了“未来四年台湾将走哪条路?过去四年你们过
得好不好?礼拜六不要做错决定。选蔡英文就是选择社会和谐,选马英九就是选择社会对抗。幸福很简单,就是每晚睡觉时,你知道明天早上会有工作。蔡英文不会
恐吓人民,只会带给人民安定,我有很多计划带给人民安定和幸福”。

在到处飘溢着臭豆腐味的造势晚会场地上,“冻蒜”声四起。

与对岸的大陆人相比,台湾人无疑多了一项名为大选的全民嘉年华狂欢。今晚人们展开布条,举着旗帜或升起气球,上面写着“女人当家,世界潮流”,“台湾新希望,全民女总统”,“客家妹仔,小英做总统”等内容,在蔡英文登场的瞬间“总统好”的呼声也响了起来。

在欢呼雀跃的人群中,不动声色的是特工警察,他们黑衣黑裤,训练有素,面无表情,手中拎着装在黑套里的冲锋枪,随时准备对付黑枪。

笔者站在记者席紧靠舞台的摄影位旁,右手边不远处,有个20来岁的白胖青年,他在歌手演唱时大声唱和,当蔡英文登场后,他突然冲到舞台边缘,冲着蔡英文狂喊“陈水扁,贪污犯”。

一阵骚动中,特工把他拽了回来,他又开口大喊,我听得特工说“你再喊,我们逮捕你!”话音刚落,白胖小子迅速后撤,消失在人群中。

至散场,长短枪只一直都静静地躺在特工们的手提袋中,2004年的两颗子弹事件没有上演,台湾选民没有受到新的惊吓。

五、选前之夜争场地 绿落蓝套

1月13日,是选前之夜。在台湾各地,国民党、民进党和亲民党都要做最后的造势活动,其声势最甚之地,当属首都台北。而台北的选前之夜,以总统府前的凯达格兰大道最为引人注目,为争得这块战略高地,各党都要展开争夺。

1月10日,民进党的机关报《自由时报》发文谈及绿营的选前之夜,称“绿营原本规划的选前之夜场地都被国民党抢先借走,最后被迫选在面积较小的农十六举行,只要人数超过三万人就会爆场。

据一位台湾政界人士透露,所谓国民党抢先借走,内含一段小插曲。数个月前的某一日,台北市府开放选前之夜的场地登记。民进党的办事人员起了个大早,
赶到登记处时还是铁将军把门,民进党人一乐,认为国民党人还在睡大觉,总统府前的场地非己莫属,大意之下掏出香烟到附近街上溜达去了。

等烟毕回到登记处,却见国民党人已排在自己前头,怎么理论也不行,最后总统府前的宝地还是归了国民党。

Having had 10 years of experience with No Child Left Behind, the federal government would do well to seriously reconfigure or scrap it
ON THE 10th anniversary of its passage, No Child Left Behind continues to garner plenty of news coverage and commentary. As the signature piece of education legislation pushed by President George W. Bush, it has, if nothing else, put a spotlight on the way America’s public schools educate most of the nation’s children. And there’s nothing wrong with that.
Known officially as the Elementary and Secondary Education Act, NCLB was approved in 2002 with bipartisan support, having been a top campaign promise of the new president. Now, after a decade of observing NCLB in action, its pros and cons are clear.
Chief among its liabilities is that it set unachievable goals and then harshly punished districts that failed to meet them. Educators felt that its one-size-fits-all objectives were unrealistic in a nation that is becoming more diverse in every category. Conservatives who initially enthused about it now use NCLB as an example of federal overreach and meddling in state and local affairs. Thanks to the Great Recession, funding for the program was drying up just when it was needed most.
While these issues are applicable to the NCLB debate in Virginia, the complaint rising above the din here is the program’s redundancy next to the state’s Standards of Accreditation, for public school accountability, and its Standards of Learning, to assess student knowledge. Initiated in the mid-1990s under the administration of then-Gov. George Allen, the SOLs, like NCLB, aim to gauge students’ proficiency in particular subject areas. In the real world of elementary and secondary school classrooms, NCLB became just another bureaucratic layer–something to steal energy from the real business of learning.
The SOLs came under fire for forcing teachers to follow a strict curriculum, challenging them to work in time for more abstract learning. (Of course, before the SOLs, too many “abstract learners” were graduating with heads lightly stocked with concrete knowledge.) As educators were making that watershed adjustment, along came No Child with another list of requirements.
With a 2014 deadline looming for a 100 percent passing rate required under NCLB, the Obama administration countered that improbability with a waiver or exemption program. Virginia was expected early this year to join 11 other states in applying for a waiver from key aspects of the program. All but five states have expressed some interest in NCLB “probation,” although many haven’t pulled the trigger out of fear they would lose federal funding.
Meanwhile, the Virginia Board of Education is in the throes of toughening the content of the much-copied SOL program.
The federal government already has ways of keeping track of student performance across the country–chiefly, the venerable National Assessment of Educational Progress, better known as “The Nation’s Report Card.”
Certainly every state welcomes federal aid for education, but as long as they are taking care of business on their own, such aid shouldn’t come with stringent NCLB strings attached.

Governor Brown says the California Commission on the Status of Women should be eliminated. State Senator Noreen Evans is chair of the Legislative Woman’s Caucus, and she disagrees.
Recently, the Governor proposed eliminating the Commission on the Status of Women-the only state agency overseeing issues impacting women.
Women have made progress in the 47 years since the first Governor Brown established the Commission, but we have a long way to go. Women are over half of the state population, but only 28% of California legislators are women. Only one Fortune 500 company in California has a woman CEO.
More than one-third of households headed by women with children have an income below the poverty level.  Compared to men, California women earn 84 cents on the dollar; African American women earn 68 cents and Latinas 59 cents.  At the same time the state has been slashing services upon which women and children rely.
Now, more than ever, women need a voice in our government.
Decisions we make to balance our budget disproportionately impact women. Programs serving primarily women and children have been decimated.  Most jobs in education, health care, and child care are held by women. These jobs are disappearing because of budget cuts. And, women are often hit by reductions in more than one service.
The Commission on the Status of Women is the official voice of California women and advises the administration on gender equity issues.
When decision-makers understand how their actions impact men and women differently, they are better prepared to make sound choices. Our government exists for the people and by the people, yet over half of the people have been historically underrepresented, undervalued, and denied.
That history can’t be eliminated and neither should the Commission on the Status of Women.

The Home Depot partnered with Habitat for Humanity on Thursday in launching the nonprofit’s new program in Utah County.
“Last year we expanded our mission to neighborhood revitalization and critical home repair,” said Nancy Mickiewicz from Habitat for Humanity in Utah County. “This is our opportunity to partner with Home Depot and help a veteran, which we are just honored to do.”
Northern Utah County resident Jim Roth was treated for Hodgkin’s lymphoma as a young man. The radiation and chemotherapy gave him another 20-year lease on life.
The cancer went into recession, but the radiation left lasting side effects of hardening arteries and nerve damage that remained dormant until 2010. Daily, he suffers from chronic, agonizing sharp pain and burning sensations in his lower spine, hips and legs.
Largely wheelchair bound — his legs are in danger of atrophying from poor circulation — he needed a way to get into and out of his house.
“The doctor told me that within the next five years I will lose a leg,” Roth said. “I don’t think I’d be alive today if I hadn’t gotten treatment. I was lucky to catch it early.”
He served 12 years in the military in infantry. His commander is the one who nagged him to get treatment.
“I was in denial,” Roth said. “The survival rate for me would have dropped down to zero if it wasn’t for the military.”
At about 9 a.m. Thursday, the fleet of vans and cars pulled up to his home and men unloaded the wood and other items to construct an entry ramp in the garage of the home.
The project was the first critical home repair sponsored by Habitat for Humanity in Utah County. The volunteers completed the ramp and also installed a water softener and water filter for Roth’s health, since he has just one kidney left.
Roth’s father-in-law, Cliff Ewell, works at The Home Depot and has known about his son-in-law’s need for about a year. His company provided a $5,000 grant for the project.
“Excited, I’m excited about it,” Ewell said. “He’s a good kid. I just love him to death.”

South Africa, home to the highest number of HIV cases in the world, should see a massive reduction in infections by the end of the decade after a change in government policy, a UNAids official said yesterday.
“It now has more people with HIV infections than any [other] country – 5.6 million. That is due to a lack of political commitment before,” said Sheila Tlou, UNAids regional director for East and Southern Africa.
“However, there is a turnaround in President Jacob Zuma’s government, which is committed in its fight against HIV and Aids,” she said.
“By 2020 there will be massive reductions in South Africa.”
Zuma, who has dramatically expanded the country’s Aids treatment programme since taking office in 2009, last month unveiled a plan to halve the number of HIV infections over the next five years.
The five-year plan is the first that has been drafted since the 2008 ousting of President Thabo Mbeki and his health minister, Manto Tshabalala-Msimang.
Tlou said east and southern Africa were known as “the centre of the epidemic” because, of the world’s 34million people living with HIV, almost three-quarters lived there.
“One of our targets is to reduce new infections by 50% by 2015,” she said.
But Tlou noted that fading commitment by the Global Fund to Fight Aids to combating tuberculosis and malaria could have a negative effect on the fight against the disease.
“There has been quite a lot of progress since 1997, with a 25% reduction in new infections in our region,” she said.
Steve Kraus, UNAids director for Asia and the Pacific, said important progress had been made in big countries such as China, India and Indonesia, and in smaller countries such as Fiji and Samoa.
Kraus said China had adopted a policy of zero tolerance of HIV.
This was later adopted by the 10 ASEAN nations.
“China is increasingly funding its national response [to HIV] and added $1-billion last year,” he said.

So why am I not equal to you?
Why do you have more than 1,200 federal rights than I do? Why do you discriminate against me? Why do you not stand up for my equality?

Raging homophobia in right-wing politics
In the hate fest that is the Republican presidential debates, one candidate after the other proudly proclaims to be more homophobic than the others. Rick Santorum. Newt Gingrich. Some have already fallen by the wayside, including Rick Perry, Michele Bachmann and Herman Cain.
“Love the sinner, hate the sin” is the ancient message they continue to send as they fawn over the Religious Right.
Many claim that being gay is a choice and can be “cured,” despite a vast library of scientific and psychological evidence to the contrary. Even the front-runner Mitt Romney, who is considered too moderate for the Religious Right, cannot resist pandering to the anti-gay foes.
Most oppose same-sex marriage and domestic partnerships, contending that marriage should be between one man and one woman. Never mind that poll after poll show a majority of Americans support marriage equality. Never mind that clinical surveys show marriage equality is good for a myriad reasons, including health, happiness and stability of the family.
Most also oppose adoption by gay parents, even though clinical evidence shows that gay parents are every bit as supportive of their adopted children as heterosexual parents and that children raised by gay parents are thriving. (Could these opponents fear that gay parents might bring up their children to be open-minded and reject hate?)
Homophobia has dire effects on LGBT youth
Homophobia is at work everywhere, not just in Republican politics.
In Australia, tennis legend Margaret Court recently stirred up a hornet’s nest, claiming that lesbians have ruined professional tennis. Now a Pentecostal minister, Court claims that homosexuality can be cured with reparative therapy, even though it is scientifically proven to be impossible. She is speaking out against gay rights just as Australia is beginning to debate marriage equality.
Homophobia takes its toll on young, impressionable youth. Anti-gay hate speech, junk science and bullying do untold damage to our youth, causing insecurity, fear, isolation and loneliness. LGBT teenagers are four times as likely as their heterosexual peers to commit suicide, statistics show.

The “no glove, no love” principle may soon be made law for adult film actors in Los Angeles, where roughly 90 per cent of U.S. pornographic films are made.
The measure is currently before Mayor Antonio Villaraigosa, and a statement from his aide suggests he is supportive of the condom requirement. On Tuesday, city council approved an ordinance that would deny film permits to producers who do not mandate the use of condoms on set.
A committee of police, city and health officials may be created to plot enforcement mechanisms.
Industry players are not taking the news lying down. Many have decried the measure as an unneeded exercise in political correctness that cannot be enforced in the city known as the porn capital of the country.
“It’s going to be interesting to see how in fact they do try to enforce it and who’s going to fund it, and all of the time and effort they’re going to spend,” said Steven Hirsch, co-founder and co-chairman of Los Angeles-based Vivid, one of the largest makers of erotic movies.
Adult film purveyors also argue that:
 Consumers complain that condoms are distracting and ruin the fantasy.
Filmmakers will just stop shooting in the city of Los Angeles, thereby dispersing an industry that produces an estimated $8 billion US a year in revenue.
The new law would be bad for business at a time when free internet pornography and recession pains have cut into profits.
Testing is the local norm, as actors are tested for sexually transmitted diseases a minimum of every 30 days when they are working.
Defenders of the ordinance argue the industry is not doing enough to police itself.
Ged Kenslea, spokesman for the AIDS Healthcare Foundation, said filmmakers have long ignored state health laws mandating the use of condoms when workers are exposed to blood-borne pathogens.
“Let’s make one thing clear: condom use on adult film sets is, and has been, the law in California under blood-borne pathogens regulations,” he said. “It is just a law that has not been uniformly enforced or followed.”
Veteran adult film actress and producer Tabitha Stevens, who has worked with and without condoms, counters that the choice should be left up to the performers and not mandated by a government agency.
“If you want to wear them, wear them. If you don’t, don’t. That’s up to the talent to decide. It shouldn’t be up to the government to decide,” she said.
